The Law Firm provides legal assistance in the field of real estate transactions, in particular such as the acquisition of individual properties and real estate portfolios, residential/office investments (land acquisition, investment process, commercialization), negotiating lease agreements (offices, warehouses, etc.).

The lawyers of the Real Estate and Investment Department also deal with matters related to the legal aspects of urban planning and spatial development as well as administrative proceedings related to the investment process, as well as conduct due diligence and prepare legal opinions, in particular for the purposes of real estate acquisition.

1. Regulation of the legal status of real estate

• advising on the recovery of land taken over on the basis of the so-called Bierut Decree (Warsaw),
• land and mortgage register proceedings, including proceedings regarding the establishment of a land and mortgage register for real estate,
• court proceedings to reconcile the legal status of real estate with the actual legal status,
• court proceedings regarding usucaption, dissolution of co-ownership of real estate.

1. Acquisition and sale of real estate

• real estate valuation analysis in terms of compliance of the valuation with generally applicable laws, selection of the valuation method and parameters of the valued real estate with its actual legal status,
• preliminary and final agreements for the sale of real estate, project companies,
• establishing mortgages, easements, other types of limited rights in rem and real estate security,
• drafting and negotiating agreements between co-owners, drafting quoad usum agreements .

1. Development activity and construction process

• proceedings to obtain administrative decisions in the construction process (change of use, exclusion of land from agricultural production, decisions on development conditions and building permits),
• drawing up and negotiating contracts for the provision of services related to real estate or the construction process (e.g. with a substitute investor, general contractor, main contractor, contracts for author's supervision, investor's supervision, project management),
• advising on contracts with media suppliers and other service providers,
• advising in court proceedings related to the broadly understood construction process.

1. Leasing / Commercialization

• drawing up and negotiating real estate brokerage agreements,
• drawing up and negotiating rental and tenancy agreements, usufruct agreements, as well as other agreements regarding the use of premises, buildings and other real estate,
• negotiating other documents with landlords or tenants (securing claims, annexes to lease agreements, transfer of rights under contracts, delivery and acceptance protocols),
• advising in disputable and pre-dispute situations.

1. Public procurement and infrastructure investments

• legal assistance in public procurement procedures and technical dialogue, support in the work of the tender committee,
• representation in court disputes arising at various stages of public procurement.

- Family and guardianship law -

We support and help in any proceedings in the area of ​​family law.
