This case was submitted in Muara Teweh District Court, Central Kalimantan after Jakarta Commercial Court has rendered its Homologation Decree in Suspension of Debt Payment. The Concurrent Creditor did not feel legally bound by the Homologation Decree eventhough the Debtor admitted its debt to the Concurrent Creditor and mentioned the Concurrent Creditor' debt within its Homologation Decree. Therefore, the Concurrent Creditor filed its Lawsuit in Muara Teweh District Court, Central Kalimantan because the Debtor has a branch office within the jusrisdiction of Muara Teweh District Court, Central Kalimantan. Me and my team went there as Defendant and we managed to obtain Interlocutory Decision in favour of Defendant which basically decided that the Lawsuit dismissed and Muara Teweh District Court, Central Kalimantan had no authorization to examine the Lawsuit. Due-Diligence-Prüfung
We involved in the acquisition of 2 (two) Crude Palm Oil Companies by conducted Legal Due Diligence towards companies' documents, licenses, agreements towards third parties, courts searches with exemption of Tax and Finance aspect and by the issuance of Legal Opinion for the basis of acquisition. We also had participated in REDD+ Project by provided Legal Due Diligence Towards numerous Mining and Plantation Companies.
