Dispute Resolution | Arbitration

F&M’s Dispute Resolution practice spans Courts as well as alternative dispute resolution. The focus of our Disputes Resolution practice is multidisciplinary strategy - our partners work in seamless collaboration with our other practices to ensure our litigation strategy is comprehensive.

Our litigation team covers both civil and criminal matters, and handles assignments ranging from property and corporate to intellectual property and taxation. We appear in and handle cases before all Courts in India, from District Courts to the Supreme Court. We also handle matters before quasi-judicial authorities and Tribunals. Our lawyers have contributed to many landmark cases which have helped develop nuances in Indian jurisprudence. Our well-regarded arbitration practice has obtained many landmark awards for our clients.

Insolvency and Bankruptcy

Our Insolvency and Bankruptcy practice includes advising both creditors and debtors, and providing end-to-end services through the process of making the application till closure of insolvency or liquidation. Our services include actions by a Financial or Operational Creditor, filing of insolvency applications, appointment of appropriate Resolution Professionals, constitution of Committee of Creditors by the Interim Resolution Professional, liquidation of the Corporate Debtor, as well as advisory and monitoring services in relation to various stakeholders such as creditors, debtors and Insolvency Professionals.

Real Estate

Legal complexity has risen in the real estate ecosystem in the last decade, with increased urbanization and unprecedented increase in residential and commercial property projects. Our Real Estate practice equips clients with tailor-made solutions to face the evolving challenges of the Real Estate Sector.

F&M’s practice covers real estate for commercial, industrial, hospitality, leisure, educational and other purposes. We offer a wide range of legal and advisory services to real estate operations/ businesses from verification of owner’s title, to ring-fencing the operations from future legal risks to ensuring regulatory compliance for the sale of purchase of assets to quick monetisation of investments in real estate projects or assets.

Our services include establishing title over land, curing defects, compliance with government and administrative regulations, and preparation of transactional documents for acquisition of land, followed through with agreements with architects, consultants, contractors, suppliers, service providers, concluding with sale and other agreements, and sale deeds with individual buyers of units. Real estate projects dealt by us range from residential complexes, mega townships, shopping malls and hospitality projects.
