Drug Related Issue

I have a question. If someone is arrested in a drug-related case in Oman and his family is not in the country, the family may try to contact him but be unable to do so because they don’t know where he is being held. The police say they can only share information with his kafeel (sponsor) or a blood relative.

My question is: if the arrested person’s brother travels to Oman to inquire about his missing brother, is there any risk that the police could arrest the brother as well, even though he is not involved in the case and the arrested person is the only one accused in the drug-related matter

Thank you for your question. In Oman, criminal liability is generally personal, meaning that an individual may only be arrested or detained if there is reasonable suspicion or evidence of their own involvement in an offense. A family member traveling to Oman solely to inquire about a detained relative does not, by itself, create legal risk, provided the family member has no connection to the alleged crime. Omani authorities may verify identity and relationship, but arresting a brother simply due to familial ties would not be consistent with standard criminal procedure.
That said, drug-related offenses are treated seriously in Oman, and authorities may be cautious in sharing information. It is advisable for the brother to carry documentation proving the family relationship (such as birth certificates or passports showing parentage) and to limit inquiries to formal channels, such as the police, public prosecutor, or through a licensed local lawyer. In practice, engaging Omani legal counsel often facilitates communication and reduces misunderstandings. We can advise on the safest approach for making inquiries and, if needed, assist in coordinating with local counsel to obtain information about the detained individual.

Sincerely,
