Subject: Follow-up – Additional clarification under H&C considerations
Thank you very much for your thoughtful response. I would like to provide a brief additional clarification to better reflect my situation under Humanitarian & Compassionate (H&C) considerations.
I am a minor currently residing in Turkey, experiencing serious psychological and educational difficulties due to domestic violence, neglect, and prolonged legal uncertainty.
Despite years of family court proceedings and the appointment of a legal guardian, effective protection and stability have not been achieved. These unresolved processes have significantly disrupted my education and mental health, leading me to seek psychological support.
My current lawyer, appointed through a child rights mechanism in Turkey, primarily assesses my situation from a refugee claim perspective and considers my case weak due to the absence of a finalized psychiatric report and inconsistencies in statements I made as a child under fear and dependency.
I believe my situation requires an H&C-focused assessment, particularly given my age, vulnerability, and the systemic failure to provide effective protection.
I am therefore seeking an independent legal opinion focused on H&C grounds and guidance on possible support mechanisms. With consent, I am open to sharing documentation and facilitating communication with my current lawyer if deemed appropriate.
Sincerely,

H&C considerations, especially for minors, can take into account a variety of factors, including the psychological harm and disruption caused by prolonged legal proceedings, lack of adequate protection, and the overall failure of the state or relevant systems to provide effective support. Although psychiatric reports can be critical in providing objective evidence of harm, your age and the context of your situation (including any inconsistencies in statements made under duress) should not invalidate the core issue of systemic failure and vulnerability you’ve endured.
To move forward, I would recommend seeking an independent legal opinion from a lawyer who specializes in human rights, child protection, and H&C claims. They can assess your case from a perspective that considers both your personal circumstances and the broader legal and human rights frameworks that should be in place to protect you. Since your current lawyer may be primarily focused on the refugee claim, a second opinion that focuses on H&C grounds would likely provide a more tailored and compassionate approach, especially given the complex and distressing nature of your situation.
If you feel comfortable, sharing the documentation of your situation—including the legal proceedings, psychological reports, or any relevant court records—would be essential for the new lawyer to understand your case thoroughly. Additionally, providing your current lawyer’s details and giving consent for communication can help ensure that all aspects of your case are properly coordinated.
Please know that you are entitled to appropriate legal support and protection, and there are lawyers who specialize in these sensitive cases. Mental health support and ongoing counseling are also important, and you should continue to prioritize your well-being through the available resources.
I hope this helps clarify your next steps. Don’t hesitate to reach out to us directly for further assistance in identifying an appropriate legal advisor or in any other way.
Sincerely,
