Divorce Procedure & Criteria (for Men):
Under Pakistani law, a husband can initiate divorce (Talaq) by:
Pronouncing divorce (written or oral) three times clearly.
Issuing a written notice of divorce to the concerned Union Council.
The Union Council will then issue a notice to the wife and initiate conciliation proceedings.
If reconciliation fails, the divorce is confirmed after 90 days from the first notice.
Khula Process (for Women):
If a woman seeks divorce (Khula), the steps are:
File a suit for Khula in the Family Court.
Provide valid reasons such as abuse, cruelty, abandonment, etc.
If reconciliation fails, the court grants a decree of Khula.
The woman may have to return Haq Mehr or agreed dower.
Criteria for Divorce/Khula:
Breakdown of marital relationship
Lack of compatibility
Cruelty, abuse, mental torture
Abandonment or refusal to provide maintenance
Adultery or immoral behavior
