How can a Ugandan business verify if exporting agricultural tools violates international sanctions?

We run a Kampala-based export business for farm tools. A potential buyer in a neighboring country requests dual-use equipment, and I’m unsure which sanctions or export licenses apply or what records to maintain. Should I hire a lawyer to review our licenses, screening procedures, and reporting obligations to avoid penalties?

Hello,

It is true that even simple farm tools can sometimes be classified as “dual-use,” which means they have both civilian and possible military applications and therefore may be subject to export controls and sanctions rules in various jurisdictions. These controls typically depend on what the item is (technical specs, classification), where it’s going (destination country’s risk profile and sanctions status), who is receiving it (end-user and intermediary screening) and what it will be used for (end-use).

You therefore need to identify the item's export clasification and screen against sanction for specific and restricted parts. These sanctions depend on the end user/buyer, any intermediaries or the country of destination.

Finally, to be on a safe side, you need to conduct due diligence about the buyers/end user, maintain properly executed records witnessed by relevant authorities/notary pubic, ensure licence or permits compliance and check the classification and anctions list by major organisation like UN, EAC etc.

I hope this feedback answers your question and we remain available for further support.
