Dispute Resolution and Arbitration - DIFC Courts

Azhari Legal Consultancy is widely experienced in dispute resolutions.

We have the experience and know-how to see a conflict and the possible dispute resolution mechanism through to the end and thus also know how to assist clients in resolving disputes prior to a trial through negotiations and meditation.

Arbitration - especially in the United Arab Emirates - can be significantly more expensive than litigation before the UAE Courts. In contrast to litigation where you have the possibility to challenge the first instance judgment before the Court of Appeal and its judgment before the Court of Cassation, an arbitrational award is final and binding. It is only in the process of recognition and enforcement of the arbitrational award that one has limited room to challenge the arbitrational award, mainly on the basis of procedural mistakes that arose during the arbitral proceedings. The arbitration procedure thus has to be carried out in a highly professional manner.

In addition, we represent Clients before the DIFC Courts. The DIFC-Courts are an independent common law jurisdiction based in the Dubai International Financial Centre (DIFC) with jurisdiction governing civil and commercial disputes. DIFC Court Judgments can be executed not only inside the DIFC, but also in the UAE. Outside the UAE, the enforcement of DIFC Judgments , decisions and orders will be exactly the same as the enforcement of a judgment of the Dubai Courts.

In litigation cases we collaborate with local advocates on a barrister-solicitor-like basis.

Labour Law

Azhari Legal Consultancy is widely experienced in structuring and drafting labour agreements for locals and expatriates. We advise employers as well as employees. In this context we attach importance to the fact that in particular foreign employers might be not aware of the “specialities” of the UAE labour law, e.g.:

o Structuring the salary in order to reduce end of service gratuities

We also advise board members, managing directors and senior executives on the negotiation and termination of their employment contracts.

Commercial Agencies

We have extensive experience in providing advice on all types of commercial agency arrangements such as franchise, distribution, agency and commission arrangements and on the impacts of local laws on such agreements, including advising on the effect of those agreements being registered with local authorities. We help our clients with the drafting of necessary commercial instruments and agreements as well as with the registration of agreements with the relevant authorities.
