Is dual representation allowed in Kuwait when two clients have conflicting interests in the same civil case?

I'm a Kuwait resident and suspect my attorney is also representing the other party in the same matter. What are the ethical rules on conflicts of interest for Kuwaiti lawyers, and what steps should I take if a conflict is suspected or undisclosed? Will I need to hire separate counsel to protect my rights?

Under law, lawyers are required to avoid conflicts of interest and to disclose any potential conflicts to their clients. If you have evidence that your attorney is also representing the opposing party in your matter, you have the right to file a complaint. Should you wish to change your attorney, you should first review your agreement with your current lawyer regarding the terms of engagement. You may also consider appointing separate counsel to protect your interests. It is advisable to seek professional guidance to review your agreement and take the appropriate steps to safeguard your legal rights.

The ethical conduct of attorneys in Kuwait are laid down in Law No. 42 of 1964. If there is any proof that the attorney is working against your interest by representing the other party, or if the attorney has not been attending the case or committing any professional fault that could lead to the failure of the case, you can raise a complaint.
