Affaires

Commercial or Business law comes with enormous amount of complications and disputes. The Primary law governing the same is the Indian Contract Act, however, every business has its own peculiarities, due to which other laws too have a significant bearing, that complicates the issue (s). For instance, a Real Estate business will have to observe the local land laws, property laws, building bye-laws, apartment laws, etc. Similarly, an IT business will need to observe the IPR laws, IT Act, privacy laws etc. On the top of it, laws related to the Company, ie. the Companies Act or the LLP Act too gain prominence since the govern the internal functioning of the said businesses. Then, Governments too bring in rules etc. under the banking laws, negotiable instruments (or cheque bounce), securities laws, insolvency & bankruptcy laws, insurance laws, arbitration, Commercial Courts Act, etc.

Immobilier

The Real Estate industry faces its own difficulties, which usually turn out to be more complex than ever thought of. The problems at the ‘Investor’ relation level itself had been one of the prime reasons of the failure of most of the projects. Additionally, regulations under the RERA, consumer complaints, government regulations, etc. simply increase the legal complications.
