The Office of the State Advocate, established in 2019 under Article 91A of the Constitution and the State Advocate Act (Chapter 603 of the Laws of Malta), serves as the principal legal advisor to the Government of Malta. This office is tasked with acting in the public interest and safeguarding the legality of state actions. It operates with constitutional independence, ensuring that its functions are performed without direction or control from any other person or authority.
The office's responsibilities encompass advising the government on proposed legislation, assisting in drafting bills, and representing the state in legal proceedings before all courts and tribunals, both domestically and internationally. Specialized units within the office focus on distinct legal fields, including the European Court of Human Rights (ECHR) Unit and the Legislation Unit. The ECHR Unit handles tasks related to the European Convention on Human Rights, drafts action plans and reports, and collaborates with the Department of Execution of Judgments in Strasbourg. Under the leadership of Dr. Christopher Soler, appointed State Advocate in October 2020, the office has enhanced its capacity and effectiveness. Dr. Soler brings extensive experience in international and human rights law, having held positions such as Director of Legal Services at the University of Malta and Chairperson of the Refugee Appeals Board. The office is committed to upholding the highest standards of legal service, ensuring transparency, accountability, and the protection of fundamental rights in Malta.
