My wife is a Philippines national and I am a UK national . We have been legally married for many years . We live in the Philippines and I wish to send funds to my wifes bank account in the Philippines from my bank abroad for the purpose of purchase of a residential family home . The title deed would be registered in both my wifes and sons name , with my name added to the sales contract as the provider of funds .
As I will be sending funds to my wifes account for the purchase , please advise if there is any way this transfer and property purchase between husband and wife could be viewed as a donation and if a donor tax of 6 % would be applied . As I understand it there should be no donor tax as it is not a donation but a simple purchase of property intended for family residence .
I know quite a few others who have been through this process but have never had to pay a donor tax , and only pay the usual taxes on a property purchase at time of sale but it would be nice to have some professional opinion .
