Divorce for irremediable breakdown may be requested by one spouse or by both spouses. If one spouse does not agree to divorce, the divorce application will be filed unilaterally by the other spouse. It may also be requested jointly by both spouses when both agree to divorce but cannot agree on the terms of their divorce.
The Civil Code defines "irremediable breakdown" as that which "makes it reasonably impossible for the spouses to continue and resume their life together". The "irremediable" nature of the breakdown is left to the judge's discretion.
In practice, "irremediable breakdown" will most often be acquired by the lapse of a period of one year (in the event of disagreement) or 6 months (in the event of agreement of the spouses to divorce) of separation. De facto separation is proven by producing residence certificates demonstrating that the spouses have not lived together since a certain date.
