Q. How long do I have to be separated from my spouse to apply for a divorce under the simplified procedure?

A. If your spouse consents, you can apply for a divorce under the simplified procedure after you have been separated for a period of one year. If your spouse does not consent, you must have been separated for at least two years before you can apply for a simplified divorce.

Q. Does a father have parental rights and responsibilities in relation to his child?

A. A father does not automatically have parental rights and responsibilities unless he is married to the mother at the time when the child was conceived or thereafter, is named on the child’s birth certificate if the birth was registered on or after 4 May 2006, or the mother has signed an agreement under s.4 of the Children’s (Scotland) Act 1995. If none of the above apply, an action would need to be raised in court seeking an order for parental rights and responsibilities.
