When a Ghanaian affidavit needs more than a signature
An affidavit is a written statement of facts sworn or affirmed before an authorised person. A statutory declaration is a formal declaration of facts made under the applicable law, rather than an oath for court proceedings.
In Ghana, the right document depends on who will receive it and what they require. Courts, public offices, schools, banks and other institutions may specify the format, wording, supporting documents or person authorised to witness it.
Signing alone does not complete the process. The person making the statement generally signs before the authorised witness, who administers the oath or affirmation and completes the jurat or attestation. A lawyer can check whether the document fits its purpose and whether it needs filing or further certification.
When legal advice can prevent problems
A court case: A lawyer can prepare an affidavit that addresses the court’s procedural requirements, identifies what is based on personal knowledge, and avoids irrelevant or unsupported claims.
Different names across records: If a Ghana Card, passport, academic certificate or other record shows a variation, a lawyer can check whether an affidavit is acceptable or whether the receiving body requires another process.
Land or business matters: A statement about a transaction, lost document or business record may affect other parties’ rights. Legal advice can help identify evidence and avoid language that creates unintended admissions.
A declaration requested by an institution: A lawyer can review the institution’s instructions and confirm whether it requires a statutory declaration, an affidavit or a different document.
A document signed outside Ghana: A lawyer can advise whether the recipient requires a particular witness, certification or authentication for a document made abroad.
Uncertain or disputed facts: Advice is useful where the statement relies on information from others, affects another person, or could expose the maker to legal consequences if inaccurate.
Ghanaian laws and court rules to know
The Statutory Declarations Act, 1971 (Act 389) provides the legislative framework for statutory declarations in Ghana. The receiving institution’s requirements still matter, so confirm the required form before making one.
The Oaths Act, 1972 (NRCD 6) concerns oaths and related formalities. It is relevant when a statement must be sworn or affirmed before an authorised person.
The High Court (Civil Procedure) Rules, 2004 (C.I. 47) set procedural rules for civil matters in the High Court, including the use of affidavits in court proceedings. The applicable requirements depend on the proceeding and any directions made by the court.
Frequently asked questions
Do I need a lawyer to make an affidavit in Ghana?
Not in every case. You may be able to prepare a straightforward statement yourself, but a lawyer can help where it will be used in court, affects another person’s rights, or must meet detailed institutional requirements.
Where can I swear or affirm an affidavit?
An affidavit must be sworn or affirmed before a person authorised to administer oaths, such as an appropriate court officer or notary public. Confirm the recipient’s requirements and the witness’s authority before attending.
What is the difference between an affidavit and a statutory declaration?
An affidavit is sworn or affirmed before an authorised witness and is commonly used in court proceedings. A statutory declaration is made in the form provided for by law and may be requested for non-court purposes.
Can I sign the document before I meet the witness?
Do not sign it in advance unless the authorised witness specifically directs otherwise. The witness generally needs to see you sign or administer the oath or affirmation as part of completing the document.
What identification should I bring?
Bring valid identification and any documents needed to check the facts in your statement. Ask the receiving institution and the person witnessing the document what identification they accept.
How much does an affidavit or statutory declaration cost?
There is no single price for every matter. Costs may include legal drafting, witnessing or commissioning charges, and any applicable filing or certification fees; request a clear estimate before proceeding.
How long does the process take?
A simple document may be prepared and witnessed on the same day if the wording, evidence and appointment are ready. Court-related or disputed matters can take longer because drafting and filing requirements may need review.
Can an affidavit explain a difference in my names?
It may help explain a discrepancy, but it does not automatically change an official record or guarantee acceptance. Ask the organisation holding the record whether it accepts an affidavit or requires another procedure.
Can I use an affidavit instead of a statutory declaration?
Not necessarily. The recipient may require one specific document, and the two are not automatically interchangeable. Check the written instructions before arranging for a document to be signed.
Can I make an affidavit while outside Ghana?
It may be possible, but the recipient in Ghana may require particular witnessing or authentication. Confirm the requirements with the receiving organisation before signing abroad.
Does an affidavit prove everything written in it?
No. An affidavit records a sworn or affirmed statement, but a court or recipient may assess its accuracy, relevance and supporting evidence. False statements can have serious legal consequences.
What if I find an error after signing?
Do not alter a completed affidavit or declaration without checking the proper procedure. The receiving body or a lawyer can advise whether a corrected document or a further statement is required.

Practical next steps for finding and hiring a lawyer
Ask the recipient what it requires. Obtain the requested document type, wording, witness qualifications and any filing or authentication instructions. This may take a day or two, depending on the organisation.
Gather relevant records. Collect identification, correspondence, court documents and evidence supporting each fact. Note which facts you know personally and which come from another source.
Shortlist lawyers who handle the relevant issue. Look for experience with court affidavits, institutional declarations, land matters or records corrections, as appropriate.
Check professional standing and arrange a consultation. Confirm the lawyer’s details with the General Legal Council and ask about availability, scope of work and fees. A consultation may be available within several days.
Agree the work and fee in writing. Confirm whether the lawyer will draft, review, witness, file or arrange certification of the document. Ask about additional charges before work begins.
Review the draft carefully. Check names, dates, locations and supporting facts before signing. Ask the lawyer to explain any wording you do not understand.
Sign before the authorised witness and follow through. Bring the required identification, complete the oath or affirmation, and obtain any filing receipt or certified copy required by the recipient.
