When a parent in Vinh must pay child maintenance

In Vinh, child maintenance usually arises when parents separate or divorce and the child lives mainly with one parent. Vietnamese law generally requires the parent who does not directly raise the child to contribute to the child’s living and education costs.

Parents can agree on the amount and payment schedule. If they cannot agree, the competent People’s Court can decide based on the child’s needs and the paying parent’s income and ability to pay. The court with jurisdiction depends on the parties’ circumstances and current venue rules, so confirm the correct filing location before submitting documents.

Useful records may include the child’s birth certificate, proof of residence, the parents’ marriage or divorce documents, evidence of the child’s expenses, and information about each parent’s income. If an order is not followed, the receiving parent can seek civil judgment enforcement.

When a lawyer may be useful

  • The other parent disputes parentage, the child’s residence, or who should pay after a separation in Vinh.

  • You need to seek maintenance as part of a divorce, or want to bring a separate claim when parents are unmarried or already divorced.

  • The paying parent has informal, irregular, or hard-to-document income, such as earnings from small businesses or self-employment in Nghệ An.

  • You need to show that a current payment amount no longer meets the child’s needs or that the paying parent’s circumstances have materially changed.

  • The other parent lives outside Vinh, cannot be located, or does not comply with an agreement or court decision.

  • You need help preparing Vietnamese-language court documents, collecting evidence, or requesting enforcement of overdue payments.

Vietnamese laws that govern child maintenance

The Law on Marriage and Family No. 52/2014/QH13, effective January 1, 2015, sets out parents’ support duties. It addresses support for minor children and adult children who cannot work and have no property to support themselves, and provides for setting or changing the amount and payment method.

The Civil Procedure Code No. 92/2015/QH13, effective July 1, 2016, governs court proceedings, including jurisdiction, evidence, mediation, and hearings. The competent court and filing venue should be checked against the parties’ current addresses and the court structure in force when filing.

The Law on Civil Judgment Enforcement No. 26/2008/QH12, effective July 1, 2009, as amended, provides the framework for enforcing enforceable court decisions. A parent owed payments may ask the competent civil judgment enforcement authority to act when the other parent does not comply.

Frequently asked questions

Who can be required to pay child maintenance?

A parent who does not directly care for the child may be required to contribute to the child’s support. The duty generally applies to minor children and can also apply to an adult child who cannot work and has no property to support themselves.

Can parents agree on the amount without going to court?

Yes. Parents can agree on the amount, payment method, and schedule. A lawyer can help put the terms in writing and assess whether a court decision is needed to make the arrangement enforceable if payments stop.

How does a court decide the amount?

The amount is based on the child’s needs and the paying parent’s income and ability to pay. Evidence of the child’s regular expenses and the parent’s earnings can help the court assess a suitable contribution.

Can maintenance be included in divorce proceedings?

Yes. Parents can ask the court handling the divorce to decide child care arrangements and maintenance. If the parents are not divorcing, a maintenance dispute may be brought separately through the competent court.

What documents should I gather before filing in Vinh?

Gather the child’s birth certificate, identification and residence information, and any marriage or divorce documents. Keep receipts or other records of the child’s expenses, evidence of payments made, and available information about each parent’s income.

What if the paying parent has no formal salary?

Irregular or self-employed income does not by itself end a parent’s support duty. Records of business activity, bank transfers, assets, and ordinary spending may help establish financial capacity, although evidence can be harder to obtain.

Can the maintenance amount or payment schedule change?

Parents may agree to revise the arrangement. If they cannot agree, a parent can ask the court to change the amount or method when circumstances justify a change, supported by evidence of the child’s needs or the parents’ finances.

How long does a court case take?

There is no reliable single timeline for every case in Vinh. Timing depends on the court’s workload, whether the other parent can be served, the evidence required, and whether the case settles or proceeds to a hearing.

Are court fees payable for a maintenance claim?

Vietnam’s court-fee rules provide an exemption for individuals claiming maintenance. Other claims combined in the same case may have different fee treatment, so confirm the applicable fees with the court or a lawyer before filing.

What if the other parent ignores a court decision?

You can apply to the competent civil judgment enforcement authority to enforce an eligible decision. Keep the decision and a clear record of missed payments, and seek advice promptly because enforcement procedures and time limits can matter.

Do I need a lawyer to apply for maintenance?

No, a parent may represent themselves. A lawyer can be particularly helpful where parentage, income, residence, cross-border issues, or enforcement is disputed, or where maintenance is part of a more complex divorce case.

Official resources in Vinh and Nghệ An

  • The People’s Court with jurisdiction over the case: Provides information on filing and handles maintenance disputes. Ask which court currently has territorial jurisdiction based on the parties’ addresses.

  • Nghệ An Department of Justice: Provides provincial justice-sector information and can direct residents to relevant legal aid or justice services.

  • The People’s Committee where the child resides: Commune- or ward-level officials handle civil-status matters, such as birth registration, and may direct residents to local administrative services. It does not replace the court’s role in deciding a disputed maintenance claim.

Steps to find and hire a child-maintenance lawyer

  1. Clarify the issue. Write down the child’s living arrangements, the amount being paid or requested, and any missed payments. This usually takes one day.

  2. Collect core records. Gather birth, marriage or divorce, residence, expense, payment, and income documents before contacting lawyers. Allow several days if records need to be requested.

  3. Shortlist local lawyers. Look for lawyers licensed to practise in Vietnam who handle family-law disputes and can work with cases connected to Vinh or Nghệ An.

  4. Arrange an initial consultation. Ask about experience with maintenance claims, evidence needed, likely procedural steps, and whether the lawyer can assist with enforcement. Compare more than one lawyer if time allows.

  5. Confirm fees and scope in writing. Ask whether the fee is fixed or hourly, which court stages it covers, and whether translation, travel, or enforcement work costs extra. Agree on the scope before signing an engagement contract.

  6. Check the filing venue and prepare the application. Have the lawyer confirm the competent court under current rules and review the Vietnamese-language documents and supporting evidence before filing.

  7. Track payments and deadlines. Keep copies of filings, court notices, agreements, and payment records. If a decision is not followed, ask promptly about applying for civil judgment enforcement.
