When a group claim may be possible in Bialystok

Polish group proceedings let at least 10 people pursue claims of the same type based on the same or similar factual or legal circumstances. They may be relevant to consumer claims and certain claims involving tort, contracts, or unjust enrichment.

The case is brought by a representative for the group, rather than by each member filing a separate lawsuit. Group cases are heard by a Regional Court; the Regional Court in Bialystok may be the proper court when venue rules point to the defendant’s residence or registered office there.

Group proceedings are opt-in: eligible people must join in the manner and by the deadline set during the case. A lawyer can assess whether the claims meet the statutory requirements or whether separate claims, a complaint to a regulator, or another route is more suitable.

When a lawyer can help with a group claim

  • Several Bialystok customers say the same bank applied a disputed loan term or fee. A lawyer can compare contracts and account records to assess whether the claims share a sufficient basis.

  • Residents who bought homes from the same developer report similar defects or delays. Counsel can assess whether the claims can be grouped and what evidence is needed to establish the common issue.

  • Customers in Bialystok face similar charges or contract terms from the same telecom, energy, or other service provider. A lawyer can identify whether the dispute belongs in group proceedings or another consumer procedure.

  • Several people suffered loss linked to the same product or event. A lawyer can examine the link between the alleged conduct, each person’s loss, and the legal requirements for a group claim.

  • You are considering joining a proposed group but are unsure about eligibility, the claim amount, or the opt-in deadline. A lawyer can review the notice and explain the consequences of joining or remaining outside the case.

Polish laws that govern group proceedings

Act on Pursuing Claims in Group Proceedings (17 December 2009) sets the main rules for group claims, including who may participate, the representative’s role, and how a case proceeds. It entered into force on 19 July 2010.

Code of Civil Procedure (17 November 1964, in force from 1 January 1965) supplies general civil court rules that apply alongside the group proceedings legislation. It governs matters such as evidence and court procedure where the special rules do not provide otherwise.

Consumer Rights Act (30 May 2014, in force from 25 December 2014) may apply when the dispute concerns consumer contracts or consumer rights. Whether it applies depends on the claim and the parties’ relationship.

Frequently asked questions

How many people are needed to start group proceedings?

At least 10 people must have claims of the same type based on the same or similar factual or legal circumstances. Meeting the numerical threshold alone is not enough; the claims must also satisfy the other statutory requirements.

Who can join a group claim?

A person may be eligible if they have a qualifying claim that fits the common basis of the case. The representative or their lawyer can explain the criteria and documents required for that particular group.

Do I need to join actively, or am I included automatically?

Group proceedings in Poland are generally opt-in. You must submit a declaration to join within the deadline set by the court notice; you are not included merely because you have a similar complaint.

Can a consumer ombudsman represent a group?

A municipal or county consumer ombudsman may act as representative in qualifying consumer cases. The Bialystok Municipal Consumer Ombudsman can provide local consumer guidance and explain whether the matter may fall within that role.

Does every group member need a separate lawyer?

The group proceeds through a representative, who is assisted by a professional legal representative as required by the special rules. Members may seek independent advice about their own eligibility, evidence, or decision to join.

What might it cost to participate?

The court fee for a group claim is generally 2% of the claim value, subject to statutory limits and rules. Legal fees are separate, and the group representative’s agreement may include a success fee capped by law at 20% of the amount awarded to group members.

How long does a group case take?

There is no fixed overall timetable, and a case may take several years. The number of members, disputes about admissibility, evidence, appeals, and settlement discussions can all affect the duration.

What evidence should I keep?

Keep contracts, invoices, payment records, correspondence, complaint responses, and any documents showing your loss. The lawyer can identify which records establish the common issue and which prove your individual claim.

Can I bring an individual claim instead?

Possibly. An individual lawsuit or another complaint procedure may be more appropriate if your circumstances differ materially from the group or the group deadline has passed.

Can the parties settle the case?

Settlement may be possible, but it must follow the procedural rules that protect the group. Before agreeing to join or accept proposed terms, check how the settlement affects your claim and any amount you may receive.

Will a Bialystok court always hear the case?

No. Group proceedings are heard by a Regional Court, but the proper venue depends on statutory jurisdiction rules, including the defendant’s residence or registered office. A lawyer can check whether the Regional Court in Bialystok is the correct court.

Official resources in Bialystok

  • Regional Court in Bialystok (Sąd Okręgowy w Białymstoku): Provides court information, including information about civil proceedings and court administration. It can clarify procedural or filing information, but does not advise either side on the merits of a claim.

  • Bialystok Municipal Consumer Ombudsman (Miejski Rzecznik Konsumentów w Białymstoku): Provides guidance to consumers and may assist with consumer disputes within its remit. Ask whether the dispute is suitable for its support or requires independent legal advice.

  • Office of Competition and Consumer Protection (UOKiK): The national competition and consumer protection authority. It publishes consumer information and handles matters within its statutory powers, but does not replace a private claim for individual compensation.

Next steps to find and hire a group proceedings lawyer

  1. Collect your records. Gather contracts, receipts, statements, complaints, and the provider’s responses over the next few days.

  2. Identify other affected people. Make a list of potential group members and the facts they appear to share, without assuming that similar experiences automatically qualify.

  3. Check for an existing case or notice. Contact the relevant consumer ombudsman or search official court information, especially if you have received a deadline to join.

  4. Compare lawyers who handle group proceedings. Ask about experience with the relevant type of claim, the proposed representative’s role, and the lawyer’s approach to evidence and group eligibility.

  5. Request a written fee explanation. Clarify court fees, legal fees, any success fee, possible adverse-cost exposure, and how expenses will be shared before signing an agreement.

  6. Confirm eligibility and deadlines. Have counsel review your documents promptly; if a court notice sets a joining deadline, act well before it expires.

  7. Agree on the engagement in writing. Confirm who will represent the group, what work is covered, how updates will be provided, and what you must do if the case settles or your circumstances change.
