When legal help is important in a Polish removal case

In Poland, deportation defense usually concerns a decision obliging a foreign national to return, detention by the Border Guard, or a transfer under the Dublin system. The case may involve an unlawful-stay allegation, an expired visa, an overstayed visa-free period, irregular work, or a refused residence application.

Polish laws that govern removal cases

The principal statute is the Act of 12 December 2013 on Foreigners, which entered into force on 1 May 2014. It regulates return decisions, entry bans, detention, residence rights, and many procedural duties of foreign nationals.

The Act of 13 June 2003 on Granting Protection to Foreigners within the Territory of the Republic of Poland governs refugee status, subsidiary protection, asylum, and related proceedings. Its non-refoulement protections can be central where return could expose a person to persecution, torture, or other serious harm.

Polish return procedures also implement Directive 2008/115/EC on common standards and procedures in Member States for returning illegally staying third-country nationals, commonly called the EU Return Directive.
