When an arrest warrant reaches Zadar: what happens next

Extradition is the legal process for transferring a person from Croatia to another country for prosecution or to serve a sentence. In Zadar, a person arrested on a foreign request may face proceedings before the Zadar County Court, depending on where they are found and the case’s jurisdiction.

The route depends on the requesting country. An EU member state generally uses a European Arrest Warrant, which operates as a judicial surrender process. Requests from other countries are handled under applicable treaties and Croatia’s rules on international legal assistance.

The court examines whether legal conditions for surrender are met; it does not decide whether the person committed the foreign offence. The request, identity evidence, applicable legal grounds, and any relevant risk of rights violations may matter. An extradition lawyer can explain the procedure, challenge legal defects, and advise on consent or opposition.

When a lawyer can make a practical difference

  • You are arrested in Zadar on a European Arrest Warrant. A lawyer can explain the hearing, the consequences of consenting to surrender, and the available grounds to oppose it.

  • A non-EU country has requested your extradition. Counsel can review the treaty basis, the alleged conduct, and whether Croatian legal requirements are satisfied.

  • You are wanted in connection with an investigation or sentence abroad. A lawyer can check whether the request concerns prosecution, an existing conviction, or another legal measure.

  • You face a parallel Croatian investigation or prosecution. Counsel can raise the overlap with Croatian proceedings and explain how it may affect the timing or handling of surrender.

  • You fear torture, inhuman treatment, or an unfair process after transfer. A lawyer can help present relevant, case-specific evidence for the court’s consideration.

  • A family member has been detained in Zadar. A lawyer can seek information through proper legal channels, explain detention and hearings, and arrange communication with the person’s other counsel.

Croatian laws and rules that govern extradition

Constitution of the Republic of Croatia, Article 9. The Constitution protects Croatian citizens from expulsion, while allowing extradition or surrender under an international treaty or the EU acquis. Article 9 was amended in 2010 to accommodate extradition and surrender obligations.

Act on International Legal Assistance in Criminal Matters. This Act, published in Official Gazette 178/04, provides the domestic framework for cooperation with countries outside the EU, alongside applicable treaties and other rules. It has been amended since enactment, so the version relevant to a particular request should be checked.

Act on Judicial Cooperation in Criminal Matters with EU Member States. Published in Official Gazette 91/10, this Act governs cooperation including European Arrest Warrants. Croatia has applied the EU surrender system since joining the EU on 1 July 2013; later amendments may affect the wording applicable to a case.

Frequently asked questions

Is extradition the same as a European Arrest Warrant?

They both concern transfer between countries, but an EU member state generally uses the European Arrest Warrant system. Requests from outside the EU are considered under international legal assistance rules and any applicable treaty.

Will a Zadar court decide whether I am guilty of the foreign offence?

No. The Croatian court considers whether the legal requirements for surrender are met, not whether the foreign accusation is true. The trial or sentence issues are generally for the requesting country’s courts.

Can a Croatian citizen be extradited?

Citizenship does not automatically prevent surrender. Article 9 of the Constitution permits extradition or surrender under an international treaty or EU law, subject to the rules governing the particular request.

Can I oppose a European Arrest Warrant?

Yes, where a legally recognised ground applies. The relevant facts may include identity, prior proceedings, legal bars, or specific human-rights concerns; a lawyer can assess which arguments are available.

What happens if I consent to surrender?

Consent can affect the procedure and may lead to a faster decision. It is important to understand the consequences before giving it, including whether consent can be withdrawn under the applicable rules.

How long does an extradition case take?

Timing depends on whether the request is an EU warrant or a non-EU extradition request, and whether the person consents or raises legal objections. European Arrest Warrant rules set decision periods, with permitted extensions in some cases; non-EU cases have no single timetable that applies to every request.

Can I be detained while the request is being considered?

Detention may be ordered under the applicable procedure, but it is not automatic in every case. A lawyer can review the grounds for detention and whether release or other measures may be requested.

Does the alleged offence have to be a crime in Croatia?

For many non-EU requests, whether the conduct is punishable in both countries can be relevant, subject to treaty provisions and legal exceptions. EU warrant rules use different categories and conditions, so the answer depends on the offence and request.

How much does an extradition lawyer in Zadar cost?

There is no single fixed fee for every case. The total depends on urgency, hearings, translation needs, and the amount of legal work; ask for written terms covering fees, expenses, and any applicable tax.

Can a lawyer in Zadar help if the request comes from another country?

Yes. A Croatian lawyer can represent you in the Croatian proceedings and coordinate with counsel in the requesting country where needed. Any foreign lawyer’s role and fees should be agreed separately.

What if the request concerns a conviction made without me present?

The court may need to consider the circumstances of the proceedings and any applicable assurances or remedies. Provide counsel with the judgment and documents showing whether you received notice, had representation, or can obtain a new hearing.

Where can I check whether a lawyer is authorised to practise in Croatia?

The Croatian Bar Association maintains information about lawyers admitted to practise. Confirm the lawyer’s status and ask about their direct experience with surrender or extradition proceedings.

Official resources in Zadar and Croatia

  • Zadar County Court. The local court may handle relevant surrender or extradition proceedings where it has jurisdiction. Its registry can provide procedural information, but not individual legal advice.

  • Ministry of Justice, Public Administration and Digital Transformation. The Ministry is a central government authority for justice and international legal cooperation. Its information can help identify the competent state authority for a request.

  • Croatian Bar Association. The Association is the professional body for Croatian lawyers and provides information to help verify a lawyer’s professional status.

Steps to find and hire an extradition lawyer

  1. Act immediately after learning of a warrant or arrest. Contact a Croatian lawyer the same day if possible, especially before agreeing to surrender or making a formal statement.

  2. Confirm the lawyer’s Croatian practising status. Check the Croatian Bar Association’s information and ask whether the lawyer has handled European Arrest Warrants or non-EU extradition requests.

  3. Provide the available documents promptly. Share arrest papers, court documents, notices, and translations, while keeping originals secure. If documents are missing, tell the lawyer what authority issued them and when.

  4. Ask for an initial case assessment. Within the first consultation, clarify the request type, the next hearing or deadline, possible legal grounds, and any urgent detention issue.

  5. Get written fee terms before work proceeds. Ask what the fee covers, how hearings and urgent work are charged, and whether translation or other expenses are additional.

  6. Agree on a communication and evidence plan. Establish who will contact family or foreign counsel, what records are needed, and how quickly the lawyer will update you about court dates.
