Responding to a mortgage foreclosure

  1. Contact the lender early

    Explain your payment difficulties and propose a repayment arrangement. Keep a copy of your proposal and any reply. [3]

  2. Read the petition and identify the requested orders

    If proceedings begin, read the petition and the Form 125 information notice that must accompany it. Note the registry, the amounts claimed and each order the lender seeks. [2] [1] [4]

  3. File and serve your response

    File a Form 67 response with all unfiled affidavits you intend to rely on at the hearing. Unless the court orders otherwise, serve 2 copies of each document on the petitioner and 1 on each other party of record. For a petition respondent, the deadline after service is 21 days if served in Canada, 35 in the United States or 49 elsewhere. [1]

  4. Attend the hearing and review the order

    Attend to put your position before the court. The court can set a redemption period for a respondent to pay the petitioner what is due under the mortgage and for costs. Read the resulting order carefully and record its deadlines. [2]

  5. Act before repayment and sale deadlines

    Arrange payment within the court’s timetable and respond promptly to sale applications. A sale may be confirmed before the repayment period expires. If payment is not made as ordered, the lender may apply for a final foreclosure order. [2]

Common questions

What if I missed the response deadline?

File promptly if you want to defend the petition; the registry accepts late responses for filing. Check whether a hearing has already taken place. The court can extend a period set by the Supreme Court Civil Rules or a court order, even after it expires. If an order was made after you failed to attend, reconsideration requires the court to be satisfied that you were not guilty of wilful delay or default. [8] [2]

Can the court approve a sale before the repayment period ends?

Yes. The person controlling the court-ordered sale can apply for confirmation before the redemption period expires. Read sale applications promptly and prepare any objection before the hearing. [2]

How can I get an accurate mortgage payout figure?

If you are the mortgagor, deliver a written request to the mortgagee for a statement of the amount needed to discharge the mortgage. The Property Law Act requires the statement to be provided free of charge. [7]

Should I sign a proposed foreclosure rescue agreement?

Get independent legal advice before signing a contract offered as a way to avoid foreclosure. [9]
