How child custody and parenting arrangements work in An Giang

Vietnamese law does not usually treat a parenting plan as a separate court document. In practice, parents agree or ask the court to decide custody, daily care, child support, contact, education, healthcare, and travel arrangements.

For a divorce or custody dispute in An Giang, the court focuses on the child’s best interests. It considers each parent’s living conditions, income, caregiving ability, conduct, and the child’s relationship with both parents.

An agreement should address practical details, including school collection, holiday contact, medical decisions, phone calls, travel between communes, and support payments. Border-area families should also address travel to Cambodia, passport or identity documents, and consent for cross-border travel.

The child’s views are considered when the child is at least seven years old. The court must generally consider placing a child under three with the mother, unless she cannot provide proper care or the parents agree otherwise in the child’s interests.

When a lawyer is especially useful

  • The parents disagree about custody. A lawyer can organise evidence about housing, income, caregiving history, schooling, and the child’s daily routine for submission to the competent People’s Court.
  • One parent lives outside An Giang or in Cambodia. Service of documents, court attendance, translation, and arrangements for contact or travel can create additional procedural issues.
  • There are allegations of violence, neglect, addiction, or unsafe care. A lawyer can help present police records, medical evidence, school information, witness statements, and protective requests.
  • A parent is blocking contact or withholding the child. Legal advice can distinguish a voluntary agreement, a court order, and conduct that may justify enforcement or a later request to change custody.
  • The child’s schooling or healthcare is disputed. A written arrangement can allocate decisions and set reliable handover procedures, particularly where parents live in different districts or communes.
  • A previous judgment or agreement no longer works. A lawyer can assess whether changed circumstances support a request to modify custody, support, or contact arrangements.

Vietnamese laws that govern custody and child arrangements

Law on Marriage and Family No. 52/2014/QH13 has applied since 1 January 2015. Articles 81 to 84 address custody after divorce, the child’s wishes, parental rights and duties, contact, support, and changes to the person directly raising the child.

Civil Procedure Code No. 92/2015/QH13 has applied since 1 July 2016. It governs family-law proceedings, jurisdiction, evidence, mediation, judgments, appeals, and enforcement-related procedure.

Resolution No. 326/2016/UBTVQH14, effective from 1 January 2017, sets court fees and charges. The amount depends on whether the case is a divorce or other family matter, whether property is disputed, and whether the court grants an exemption or reduction.

Other rules may apply to civil-status records, child protection, identity documents, and cross-border travel. A lawyer should check the current text and any later amendments before filing.

Frequently asked questions about child custody and parenting arrangements

Does Vietnam have a formal parenting-plan procedure?

Not usually. Parents normally record their agreement in divorce proceedings or ask the court to decide custody, contact, support, and major child-related decisions.

Can parents agree on custody without going to court?

They can agree on daily care, contact, support, and other arrangements. If they are divorcing, the agreement may be reviewed by the court, which must reject terms contrary to the child’s interests.

Which court handles a custody dispute in An Giang?

Jurisdiction commonly depends on the respondent’s residence and the type of family case. The correct People’s Court may differ where a parent lives elsewhere, cannot be located, or the dispute includes international elements.

A lawyer or the court registry should confirm the current territorial jurisdiction before filing, especially after changes to court organisation or administrative boundaries.

How does the court decide which parent raises the child?

The court examines the child’s best interests, including stable housing, financial and caregiving capacity, health, conduct, and continuity of education. Income alone does not automatically determine custody.

The court may also consider the child’s relationship with each parent and whether either parent obstructs the other’s lawful contact.

Must a child choose between the parents?

No. A child aged seven or older is generally heard, but the child’s opinion is not the only factor and is not automatically decisive.

The court should consider the child’s maturity, circumstances, and whether pressure or coaching may have influenced the statement.

Can the father obtain custody of a child under three?

Yes, but the usual legal starting point is that a child under three is assigned to the mother unless she cannot provide proper care or the parents have another arrangement serving the child’s interests.

The court may examine health, safety, caregiving, and living conditions rather than applying the age rule mechanically.

Does the parent without custody still have contact rights?

Generally, yes. The parent who does not directly raise the child retains the right to visit and maintain a relationship, unless contact harms the child.

The parent with custody must not obstruct lawful contact. The court can address harmful or disruptive contact and may consider changing custody in serious cases.

How is child support calculated?

Parents must support their minor children, and support can continue for an adult child who cannot work and has no assets to support themselves. The amount depends on the child’s needs and the paying parent’s actual ability.

The agreement or judgment should state the payment amount, due date, method, and any adjustment mechanism. Evidence of income and regular child expenses is useful.

How much does a custody or divorce lawyer cost in An Giang?

Legal fees are not fixed by one national tariff for private lawyers. A lawyer may charge a fixed fee, hourly fee, staged fee, or a combination, depending on disputes, evidence, hearings, property issues, and cross-border work.

Ask for a written scope of work, fee schedule, court-fee estimate, translation charges, travel expenses, and the treatment of appeals or enforcement.

How long does a custody case take?

An agreed and complete matter may move faster than a contested case. Disputes involving witnesses, expert evidence, child-protection concerns, absent parties, or overseas service usually take longer.

The court controls the timetable, so a lawyer should provide an estimate only after reviewing jurisdiction, documents, and the level of disagreement.

Can a custody order be changed later?

Yes. A parent may seek a change where circumstances materially affect the child’s interests, such as unsafe care, relocation, persistent contact obstruction, or a major change in the child’s needs.

A new application should explain the changed circumstances and include current evidence rather than simply repeating the original disagreement.

Can a parent take the child from An Giang to Cambodia?

Travel arrangements should be addressed in the written agreement or court decision, including consent, identity documents, destination, duration, and return arrangements. A custody order does not automatically resolve every immigration or border-control requirement.

Cross-border disputes may involve additional jurisdiction and enforcement questions. Obtain advice before moving the child or withholding consent.

Practical steps to choose and hire a lawyer

  1. Clarify the issue within one to two days. Decide whether the matter concerns divorce, initial custody, contact obstruction, support, relocation, enforcement, or a change to an existing decision.
  2. Collect core documents over the next week. Gather identity documents, marriage and birth records, residence information, court papers, school or medical records, payment evidence, and relevant messages or photographs.
  3. Obtain two or three consultations. Ask whether the lawyer regularly handles family cases in An Giang, which court is likely to have jurisdiction, and whether cross-border or child-protection issues require additional work.
  4. Compare the proposed strategy and evidence plan. A suitable lawyer should explain settlement, mediation, litigation, interim options, likely risks, and the documents still needed.
  5. Confirm fees in writing before instructing the lawyer. Check the scope, payment stages, court charges, travel and translation expenses, appeal work, termination terms, and who will attend each hearing.
  6. Sign an engagement agreement and prepare the filing promptly. The lawyer should verify the petition, supporting evidence, service address, and requested custody and contact terms before submission.
  7. Keep a dated record during the case. Record missed contact, support payments, handovers, school events, and new safety concerns, and provide updates promptly when circumstances change.
