Sanctions & Export Controls
We received an order for industrial spare parts, but the buyer won’t clearly disclose the final end user and destination. I’m worried we could breach sanctions or export control rules if the goods are rerouted. What checks and clauses should we put in place before shipping?

Thank you for your inquiry. In principle, an Indonesian company may export machine parts; however, the situation you described raises significant sanctions and export control risks, particularly due to the lack of clarity regarding the final end user and destination....

When trade sanctions and export controls can affect a Bali business

Bali businesses may face sanctions and export-control issues when goods, payments, customers, or end users connect with restricted parties or destinations. This can arise in exports of seafood, furniture, crafts, and other goods, as well as imports of controlled equipment.

The rules are Indonesian national laws, not separate Bali regulations. The applicable requirements depend on the goods, their classification and origin, the destination and end use, and any foreign-country connection in the transaction.

A lawyer can assess Indonesian requirements and explain whether foreign sanctions may also matter. Foreign rules do not automatically apply to every Bali transaction, but a foreign bank, buyer, carrier, or US-origin item may create an additional legal or commercial connection.

Why you may need a lawyer

  • A Bali exporter’s shipment is held at customs because its product classification, export approval, or supporting documents are questioned.

  • A resort, marine operator, or technology business plans to import or re-export drones, communications equipment, or other goods that may have licensing or end-use restrictions.

  • A buyer, bank, or shipping company asks a Bali business to screen owners, customers, or end users against sanctions lists before accepting a payment or shipment.

  • A payment is delayed or rejected after a bank identifies a possible match involving a customer, beneficial owner, destination, or vessel.

  • A company receives a customs inquiry or enforcement notice concerning an export declaration, permit, product description, or suspected restricted transaction.

  • A Bali business is negotiating a cross-border contract and needs to assess sanctions clauses, screening duties, or the risk of goods being diverted to another end user.

Indonesian laws and rules to know

Law No. 7 of 2014 on Trade provides the national framework for trade, including controls on exports and imports. It was amended by Law No. 6 of 2023 on the Enactment of Government Regulation in Lieu of Law No. 2 of 2022 on Job Creation.

Government Regulation No. 29 of 2021 on the Implementation of the Trade Sector, effective from 2 February 2021, sets out implementing rules for trade, including requirements relevant to export and import activities. Specific restrictions and permits can also depend on current ministerial rules for the goods concerned.

Law No. 10 of 1995 on Customs, as amended by Law No. 17 of 2006, governs customs administration and enforcement, including export declarations and customs obligations. For targeted financial sanctions linked to terrorism financing, Law No. 9 of 2013 on the Prevention and Eradication of the Crime of Terrorism Financing is also relevant.

Frequently asked questions

Does Indonesia have sanctions rules that apply in Bali?

Yes. Indonesian national rules apply in Bali, including rules concerning targeted financial sanctions and terrorism financing. Indonesia-based businesses should assess those rules separately from any foreign sanctions regime that may have a connection to their transaction.

Do US, EU, or UK sanctions automatically apply to a Bali company?

Not automatically in every case. Their relevance can depend on factors such as the parties, goods, currency, banks, carriers, and transaction route. A lawyer can assess whether a particular foreign regime may create legal or practical exposure.

Which exports from Bali may need extra checks?

Requirements depend on the product and current trade rules, rather than on a general Bali-only list. Check the product classification, destination, end user, and any applicable export prohibition, restriction, or permit requirement before shipment.

Do I need a permit before exporting goods from Bali?

Some goods may be exported without a special approval, while others are prohibited, restricted, or subject to permits and supporting documents. Confirm the current requirements for the specific goods before committing to a shipment or delivery date.

What should I do if customs holds my shipment?

Obtain the written notice or explanation, shipment and export documents, product classification, and any permit records. A lawyer can review the issue, advise on a response, and coordinate with customs or other relevant authorities.

Can a lawyer help if a bank blocks or delays a payment?

Yes. Counsel can help identify whether the concern relates to a list match, missing information, a foreign sanctions policy, or another compliance issue. A lawyer cannot guarantee that a bank will process or release a payment.

Can a lawyer remove a person or company from a sanctions list?

Only the competent authority responsible for the relevant listing can change or remove it. A lawyer can assess the applicable process, prepare a request or supporting evidence where available, and communicate with the relevant institution.

What documents should I prepare for an initial consultation?

Gather invoices, contracts, product descriptions and classification details, permits, shipping records, payment messages, and communications from customs or a bank. Include information about counterparties, beneficial owners, destination, and intended end use where available.

How much does a sanctions and export-control lawyer cost in Bali?

There is no single statutory fee for this work. Fees depend on the scope, urgency, documents, and whether advice is needed on Indonesian law, foreign rules, or both. Ask for a written scope and fee proposal before engaging counsel.

How long does a review or permit issue take?

A document review may be quicker than a matter involving a customs hold, an authority inquiry, or a foreign bank. There is no single timeline for these processes, so ask counsel to identify the immediate deadlines and give an estimate based on the specific issue.

Can a customs broker replace a lawyer?

A customs broker can assist with customs declarations and shipment procedures within their role. A lawyer is better placed to advise on legal exposure, sanctions screening, enforcement notices, contract risks, or disputes with authorities.

Can a Bali-based lawyer advise on foreign sanctions?

A Bali-based Indonesian lawyer can assess Indonesian law and help identify foreign-law issues. If the matter requires advice on another country’s law, ask whether the lawyer will coordinate with counsel qualified in that jurisdiction.

Official resources

  • Directorate General of Customs and Excise, Ministry of Finance: handles customs administration and enforcement, including export declarations and customs inquiries through its regional offices.

  • Ministry of Trade: administers trade policy and rules, including export and import requirements for regulated goods.

Next steps for finding and hiring a lawyer

  1. Define the issue. Note the goods, parties, destination, end use, payment route, and any customs or bank deadline. Allow a day to assemble the basic facts and documents.

  2. Identify the needed expertise. Decide whether the matter concerns export permits, customs enforcement, financial restrictions, contract terms, or foreign sanctions exposure.

  3. Shortlist suitable Indonesian counsel. Look for an advocate with relevant trade, customs, financial-regulatory, or cross-border compliance experience. Confirm who will handle any foreign-law questions.

  4. Arrange an initial consultation. Share a concise chronology and key documents securely. Ask what immediate steps can protect a shipment, payment, or response deadline.

  5. Compare written proposals. Request the proposed scope, fees, expected deliverables, exclusions, and likely need for specialist or foreign counsel. Allow several days to compare options where the matter is not urgent.

  6. Check professional details and engagement terms. Confirm the lawyer’s Indonesian advocate status, responsible contact, confidentiality arrangements, and written engagement terms before sharing sensitive records or instructing work.

  7. Agree on a response plan. Set priorities, document responsibilities, and follow-up dates with counsel. If an authority or bank has set a deadline, raise it at the outset rather than waiting for the first review to finish.
