Making a valid will in Kikuyu: what to plan for

A will lets you state who should inherit property you own and name an executor to seek authority to administer your estate. In Kikuyu, that may involve checking title records for land or a house, listing rental income and financial accounts, and identifying beneficiaries clearly.

A will cannot give away property you do not own or override another person’s legal share in jointly owned property. Family circumstances also matter: a surviving spouse or child who was not adequately provided for may apply to court for reasonable provision from the estate.

You do not generally have to hire a lawyer to make a will. Legal advice can help with execution formalities, ownership questions, family arrangements, and later probate, especially where property or beneficiaries are spread across different places.

When a lawyer can help with a will

  • You own agricultural land or a home in or around Kikuyu, and need to distinguish property registered in your name from jointly owned or family property.

  • You have a blended family, a customary or potentially disputed marriage, or children from different relationships, and want the will to identify beneficiaries clearly.

  • You want to leave property to a minor, appoint someone to manage the estate, or reduce the risk of disputes over who should act as executor.

  • A relative is pressuring you to change your will, or there may later be questions about your understanding, free choice, or ability to sign it.

  • You have already found a will but need to apply for probate, locate estate assets, or address a challenge by a beneficiary or dependant.

Kenyan laws relevant to wills and succession

The Law of Succession Act, Cap. 160, has been in force since 1 July 1981. It governs wills and estate administration in Kenya, including the capacity to make a will, formalities for written wills, and applications for provision by dependants.

The Probate and Administration Rules, 1980 set out procedures and forms used in succession proceedings. The appropriate court and registry depend on the case and the court’s jurisdiction, so confirm the filing venue before lodging an application.

The Marriage Act, 2014 commenced on 20 May 2014 and provides for the recognition and registration of marriages. Whether someone qualifies as a surviving spouse can affect succession rights, so marriage records and the facts of the relationship may need careful review.

Frequently asked questions

Do I need a lawyer to make a will in Kikuyu?

No general rule requires a lawyer to draft a will. However, a lawyer can check that it meets legal formalities and deals appropriately with land, family circumstances, and any possible claims by dependants.

Who is eligible to make a will in Kenya?

Under the Law of Succession Act, a person aged 18 or older may make a will if they have the required mental capacity. The will must be made voluntarily and follow the applicable formalities.

What makes a written will valid?

Generally, the maker must sign the will, or direct another person to sign in their presence. At least two competent witnesses must attest it, subject to the statutory requirements; a lawyer can help ensure the signing is properly carried out.

Can I make an oral will instead?

An oral will generally requires the maker to speak before at least two competent witnesses. It is usually invalid if the maker survives for more than three months after making it, with a statutory exception for members of the armed forces or merchant marine on service.

Can my will leave Kikuyu land to anyone I choose?

You can generally dispose by will of property that belongs to you, but not another person’s share in jointly owned property. Check the title and ownership records before describing land or a house in the will.

Can a spouse or child challenge what my will says?

A dependant who was not adequately provided for may apply to court for reasonable provision from the estate. A will may also be disputed on grounds such as lack of capacity, undue influence, or failure to meet execution requirements.

How much does it cost to hire a wills lawyer?

Fees depend on the work involved, such as drafting a straightforward will, reviewing property ownership, or advising on a complex family situation. Ask for a written fee estimate that states what is included and whether later probate work is charged separately.

How long does it take to prepare a will?

A straightforward will may be prepared within days once the lawyer has the necessary instructions and documents. Ownership checks, unclear family details, or revisions can extend the process.

How long does probate take after death?

There is no single timeline for every estate. The time depends on the court process, the completeness of the application, the assets involved, and whether beneficiaries or dependants raise objections.

Is a will the same as applying for succession after someone dies?

No. A will records the maker’s wishes, while probate is the court process for confirming the will and authorising the executor to administer the estate. The executor generally needs the appropriate grant before dealing with estate assets.

Can I change or revoke my will?

A person with capacity can generally change or revoke a will in accordance with the law. Ask a lawyer how to make the change formally and deal with earlier copies, so there is less risk of uncertainty about which document applies.

Next steps to find and hire a lawyer

  1. Within a day or two, identify advocates who handle wills and succession matters in Kikuyu or nearby Kiambu County court locations.

  2. Before booking, check the advocate’s professional standing through the Law Society of Kenya and ask about their work on wills, land ownership, and probate.

  3. Prepare a list of assets, intended beneficiaries, possible executors, and any family circumstances that could affect inheritance. Gather available title documents, account details, and marriage or birth records.

  4. Arrange an initial consultation, often within a week, and ask how the lawyer will assess ownership, capacity, witnesses, and potential dependant claims.

  5. Request a written fee estimate and scope of work before instructing the lawyer. Clarify whether the fee covers only drafting or also signing arrangements, storage advice, and later probate assistance.

  6. Review the draft carefully, correct names and property details, and sign it using the required witness formalities. Keep the original secure and tell the executor where it can be found.
