What a will can do for Sanad residents - and what it cannot

Sanad has no separate local will-making rules: the relevant law is Bahraini national law, alongside any applicable foreign law. A will concerning a Sanad home, bank account or other property should be reviewed against the rules governing that asset and the maker’s personal status.

For Muslim estates, inheritance shares and permitted bequests are governed by applicable Islamic personal-status rules. A will generally cannot replace those rules: a bequest is usually limited to one-third of the net estate, and a bequest to an heir may require the other heirs’ consent after the maker’s death.

For foreign nationals, Bahrain’s conflict-of-laws rules may make the deceased person’s nationality law relevant to inheritance and wills. The competent court may need evidence of that law, and Bahrain rules can also affect local procedures and assets.

Making or authenticating a will does not itself transfer property or settle an estate. After death, the competent authorities may need to establish the heirs, determine applicable shares, address debts and complete asset transfers.

When a lawyer can help with a will in Sanad

  • You are an expatriate with assets in Bahrain. A lawyer can assess which law may govern your estate and whether your proposed will works for property or accounts held locally.

  • Your family includes people with different nationalities or religions. The applicable rules may not be obvious, especially where the maker, spouse, children and assets are connected to different countries.

  • You want to leave assets to someone who may be an heir. A lawyer can explain restrictions on bequests and whether consent or another lawful arrangement may be needed.

  • You own a home or other property in Sanad. Advice can help distinguish what you own and can dispose of from jointly owned property, secured assets or property subject to other restrictions.

  • You have an existing will from another country. A lawyer can review whether it covers Bahrain assets, meets relevant formal requirements and conflicts with another will.

  • Your family is already dealing with an estate. A lawyer can help identify the competent court or authority, prepare supporting documents and address disagreements over heirs, debts or the will’s validity.

Bahrain laws relevant to wills and inheritance

Family Law, Law No. 19 of 2017. This law governs family and personal-status matters, including relevant rules on wills and inheritance. Its application depends on the person’s circumstances and the applicable personal-status rules.

Civil Code, Legislative Decree No. 19 of 2001. The Code includes Bahrain’s conflict-of-laws rules. In particular, the law of a deceased person’s nationality at death may govern inheritance and wills, subject to the court’s assessment of applicable rules and evidence.

Notaries Public Law, Legislative Decree No. 14 of 1996. This law concerns notarial functions, including authentication of documents. Notarisation can support proof of a document, but it does not by itself determine who inherits or make an otherwise invalid provision effective.

Frequently asked questions

Are wills governed by a special law in Sanad?

No. Sanad is within Bahrain, and there is no separate Sanad will code. The applicable rules depend on Bahraini law, personal status, nationality and the location and nature of the assets.

Do I need a lawyer to make a will in Bahrain?

A lawyer is not necessarily required for every will, but advice is prudent where the estate includes Bahrain property, foreign assets, mixed nationalities or a proposed bequest to an heir. A lawyer can also check that the document’s form and terms fit the law likely to apply.

Can a foreign national make a will while living in Sanad?

Foreign nationals can seek to make a will in Bahrain, but the governing law and formal requirements depend on their circumstances. Ask a lawyer to assess how Bahrain’s conflict-of-laws rules interact with the person’s nationality law and local assets.

Which country’s law applies to a foreign resident’s estate?

Bahrain’s Civil Code points to the law of the deceased person’s nationality at death for inheritance and wills. The relevant court may require reliable evidence of that foreign law, so residence in Sanad alone does not settle the question.

Can a Muslim leave all assets to one person?

Usually not by will alone. Under Islamic inheritance rules, a bequest is generally limited to one-third of the net estate, and a bequest to an heir may require the other heirs’ consent after death. A lawyer should assess the applicable rules and the family’s circumstances.

Does a spouse automatically inherit everything if there is no will?

No general answer applies to every estate. The spouse’s entitlement depends on the applicable inheritance law, the other heirs and the estate’s circumstances; a will does not necessarily displace fixed inheritance entitlements.

Must a will be notarised in Bahrain?

Whether notarisation is required depends on the applicable law and the type of document. Notarial authentication may help establish identity, signing or document authenticity, but it does not guarantee that every provision will be enforceable.

Can one will cover property in Bahrain and another country?

It may, but a single document can create uncertainty if different laws or formalities apply to different assets. Ask a lawyer whether coordinated wills are safer and ensure that a later document will not unintentionally revoke an earlier one.

How long does preparing a will take?

A straightforward draft may take several days once the lawyer has the necessary information. Foreign-law research, translations, complex ownership or arranging formal signing can extend the process.

How much does a will lawyer cost in Sanad?

Legal fees depend on the estate, the advice required and whether foreign-law review or translation is needed. Request a written fee estimate that separates drafting, consultations, document authentication and any additional work.

What happens when someone dies without a will?

The estate is dealt with under the inheritance law found to apply, rather than according to the deceased person’s informal wishes. Heirs may need to establish their status and complete court or administrative steps before assets can be transferred.

Can relatives challenge a will?

A challenge may concern capacity, signing formalities, authenticity, the applicable law or whether a provision exceeds what the maker could legally give. The competent court assesses the evidence and the governing rules.

Official resources

  • Ministry of Justice, Islamic Affairs and Waqf: Provides information about Bahrain’s justice services and relevant ministry functions, including notarial services. Confirm current document and appointment requirements directly with the ministry.

  • Bahrain’s Sharia courts: The competent court can deal with relevant personal-status and inheritance matters where those rules apply. The appropriate court and procedure depend on the parties and the case.

  • Survey and Land Registration Bureau: Handles land registration matters. Its records and procedures may be relevant when an estate includes registered property in Sanad.

Steps to find and hire a will lawyer

  1. List your assets and family circumstances. In one or two days, note property, accounts, debts, jointly owned assets, beneficiaries, nationalities and any existing wills.

  2. Shortlist lawyers who handle wills and inheritance. Ask whether they advise on Bahraini personal-status law, foreign nationals and cross-border estates relevant to your situation.

  3. Check credentials and relevant experience. Ask for the lawyer’s current Bahrain practising credentials and verify them through the competent official channel before sharing sensitive documents.

  4. Arrange an initial consultation. Provide a brief asset and family summary, then ask which law may apply, what documents are needed and whether foreign-law advice is necessary.

  5. Compare written fee estimates. Before instructing a lawyer, confirm what the fee covers, likely additional costs, translation or authentication charges, and the expected drafting timetable.

  6. Review and sign the final document carefully. Check names, asset descriptions, beneficiaries and any revocation wording. Follow the lawyer’s instructions for witnesses, notarisation, storage and keeping related documents consistent.
