How to challenge a criminal conviction from Wiyung

A person convicted of a crime may have routes to challenge the judgment, depending on the case stage and the available evidence. These can include an ordinary appeal, cassation, or an extraordinary review called peninjauan kembali (PK).

Wiyung is part of Surabaya, but the court handling a case depends mainly on where the alleged offense occurred and the rules of jurisdiction. A case within the jurisdiction of the Surabaya District Court may proceed to the Surabaya High Court on appeal, then to the Supreme Court through the relevant procedure.

Deadlines and grounds differ at each stage. A lawyer can review the judgment, hearing record, evidence, and filing dates to identify a viable route and preserve the right to apply.

When a lawyer may be important in a conviction challenge

Legal help can matter when the record is complex, a deadline is close, or the consequences of the judgment are serious. Examples that may arise in Wiyung or elsewhere in Surabaya include:

  • A witness or suspect was misidentified after an incident near a Wiyung home, shop, or road, and nearby CCTV or other records may clarify who was present.
  • Police allegedly relied on a disputed search, seizure, or interview, and the defense needs to compare the account with arrest records, medical records, or testimony.
  • A conviction depends heavily on phone messages, location data, or other digital evidence whose source, handling, or accuracy is disputed.
  • A key witness has changed an account or new evidence has emerged after the judgment, requiring assessment of whether it supports a lawful appeal or PK.
  • The person or family has received a judgment from the Surabaya District Court and needs to act within the applicable appeal period.
  • The conviction is final, but the person believes the court overlooked decisive evidence or made a clear error in applying the law.

Indonesian laws that govern conviction challenges

Law No. 8 of 1981 on Criminal Procedure (KUHAP), promulgated on 31 December 1981, governs criminal procedure. It sets out appeal and cassation procedures and the grounds and process for PK, including in Articles 233, 245, and 263.

Law No. 48 of 2009 on Judicial Power, promulgated on 29 October 2009, sets out the framework for judicial authority and the Supreme Court’s role in reviewing court decisions. It should be read alongside the procedural rules that apply to the particular case.

Law No. 14 of 1985 on the Supreme Court, promulgated on 30 December 1985 and amended by Laws No. 5 of 2004 and No. 3 of 2009, governs the Supreme Court. Criminal case deadlines and PK grounds should be checked under the applicable procedural provisions and current court practice.

Frequently asked questions

What does challenging a criminal conviction involve?

It means asking a higher court, or in specified circumstances the Supreme Court, to review a criminal judgment. The correct procedure depends on whether the judgment is still open to ordinary appeal or has become final.

Which court handles a criminal case connected to Wiyung?

Wiyung is within Surabaya, but residence alone does not determine which court has jurisdiction. The court generally depends on where the alleged offense occurred and other procedural rules, so check the case caption and judgment.

How long do I have to appeal a District Court judgment?

Under KUHAP, an appeal is generally requested within seven days of the judgment being pronounced, subject to the rules for the particular circumstances. Treat the deadline as urgent and have counsel verify the date and filing requirements from the court record.

Can a final conviction be reviewed?

A person convicted by a final judgment may be able to seek PK through the criminal procedure set out in KUHAP. It is an exceptional remedy, not a new trial available simply because the person disagrees with the result.

What can support a PK application?

KUHAP identifies grounds including newly discovered circumstances, conflicting final decisions, and a clear judicial error. A lawyer should assess whether the evidence is genuinely new or otherwise meets the statutory requirements.

Can a family member apply for review?

KUHAP permits a convicted person or, in specified circumstances, an heir to seek PK. The applicant’s standing and required documents should be checked before filing.

Does filing a PK application stop imprisonment?

Generally, filing PK does not suspend execution of the judgment under KUHAP. The person should not assume release will follow while the application is pending.

How long does a conviction challenge take?

There is no reliable single timeline for appeals, cassation, or PK. Timing depends on the court stage, record preparation, filings, and the court’s workload.

How much does a lawyer cost?

Private lawyer fees are not set at one standard amount for every conviction challenge. Ask for a written engagement letter explaining the fee, included court work, expenses, and any additional charges.

Can I get free legal assistance?

People unable to afford counsel may qualify for assistance through an accredited legal aid provider under Indonesia’s legal aid system. Eligibility and available services depend on the provider and the documents supplied, so contact one promptly.

Can I claim compensation or rehabilitation after a wrongful conviction?

KUHAP provides for compensation in specified cases involving unlawful arrest, detention, prosecution, or trial, including certain errors in the person or application of law. It also provides for rehabilitation in circumstances such as a final acquittal or release from prosecution; eligibility depends on the judgment and facts.

Official resources in Surabaya and Indonesia

  • Surabaya High Court (Pengadilan Tinggi Surabaya): Hears appeals from district courts within its jurisdiction, including eligible appeals from the Surabaya District Court.

Steps to find and hire a conviction-challenge lawyer

  1. Collect the key documents. Gather the judgment, charge, appeal or cassation decisions, hearing records if available, and any evidence supporting the challenge. Do this immediately if a filing deadline may be running.
  2. Confirm the case stage and dates. Check when the judgment was pronounced or notified and whether it is final. Ask the court clerk or a lawyer to verify the deadline promptly.
  3. Find lawyers who handle criminal appeals and PK. Ask the Surabaya District Court or a legal aid provider for general referral information, and verify each lawyer’s current professional status independently.
  4. Arrange an initial review within days if possible. Ask the lawyer to identify the available procedure, legal grounds, risks, evidence gaps, and immediate deadlines before agreeing to representation.
  5. Compare written fee proposals. Request the scope of work, payment schedule, court-related expenses, and any charges for additional hearings in writing. If cost is a barrier, contact an accredited legal aid provider promptly.
  6. Agree on representation and preserve evidence. Sign a written engagement or legal aid agreement, authorize access to relevant records, and preserve original documents, device data, and contact details for witnesses.
