When a dismissal in Bali may be unlawful and what to do next

Indonesia’s national employment laws apply in Bali. A dispute may arise if an employer ends employment without a legally recognised basis, fails to follow the required process, or does not pay the termination entitlements due.

These issues can affect workers in Bali’s hotels, restaurants, tourism businesses, construction sites, and outsourced services. The facts matter: the type of employment agreement, the stated reason for dismissal, and the worker’s pay and length of service can affect the outcome.

Workers and employers are generally expected to try direct negotiation before pursuing formal resolution. If that fails, the dispute can go through local manpower mediation and, if unresolved, to the Industrial Relations Court with jurisdiction in Bali.

When a lawyer can help with a termination dispute

A lawyer can assess the dismissal, calculate potential entitlements, prepare negotiations, and guide a case through mediation or court. Local advice may be especially useful in situations such as these:

  • A hotel or restaurant restructures, closes, or reduces staff, and the worker disputes the reason, notice, or proposed payment.
  • A tourism or event worker on a fixed-term agreement is dismissed before the agreed end date, or is not paid the compensation due when the agreement ends.
  • An outsourced cleaner, security guard, or other service worker is dismissed, and there is uncertainty about which company was the employer or responsible for payment.
  • A worker is pressured to resign or sign a settlement without time to understand its effect on pay, severance, or other rights.
  • An employee alleges dismissal after raising concerns about unpaid wages, working conditions, or another workplace issue, and needs help preserving evidence and presenting the claim.

Indonesian laws that govern termination in Bali

Employment termination in Bali is governed mainly by national legislation, not a separate Bali termination code. These laws provide the core rules and procedures:

  • Law No. 13 of 2003 on Manpower, as amended, including by Law No. 6 of 2023, which enacted the Job Creation regulation in place of the earlier emergency regulation. It sets the general employment framework, including termination and worker entitlements.
  • Government Regulation No. 35 of 2021 on Fixed-Term Employment Agreements, Outsourcing, Working Time and Rest Time, and Termination of Employment, effective February 2, 2021. It covers termination procedures and related payments, including rules for fixed-term agreements.
  • Law No. 2 of 2004 on Industrial Relations Dispute Settlement, effective January 14, 2006. It establishes the negotiation, mediation, and court process for employment disputes.

Under Government Regulation No. 35 of 2021, an employer generally must give written notice of a proposed termination and its reasons. A worker who rejects the notice generally must submit a written objection within seven working days of receiving it.

Frequently asked questions

What makes a dismissal unlawful?

A dismissal may be challenged if the employer lacks a lawful basis, fails to follow the required procedure, or does not pay the entitlements due. Whether the dismissal is unlawful depends on the employment agreement, the reason given, and the evidence.

Can an employer dismiss someone without giving a reason?

Indonesian employment law does not operate on a general at-will basis. Employers must follow the applicable legal grounds and termination procedures, including notice requirements.

Do I need a lawyer to challenge a dismissal?

You are not generally required to have a lawyer to negotiate, attend mediation, or bring a claim. A lawyer can help assess the case, calculate entitlements, and meet procedural requirements, particularly if the employer disputes the facts.

What should I do if I reject the employer’s termination notice?

Respond in writing within seven working days of receiving the notice, stating that you reject it. Keep proof of delivery and seek advice promptly about the next steps.

What happens before a case reaches court?

The worker and employer must first attempt bipartite negotiation. If they do not resolve the dispute, it can be recorded with the relevant local manpower office for mediation before a court claim is filed.

How long does a termination case take?

Bipartite negotiations have a statutory period of up to 30 working days. Mediation and court proceedings can take longer; the law sets a 50-working-day period for the Industrial Relations Court to issue its decision after the first hearing.

How much compensation might I receive?

The amount depends on the reason for termination, length of service, wages, and applicable entitlements. A lawyer can review the employment records and calculate what may be payable under the relevant rules.

Do fixed-term workers have rights when employment ends?

Yes. Fixed-term workers may be entitled to compensation when an agreement ends, subject to the rules and eligibility conditions in Government Regulation No. 35 of 2021. Early termination can raise additional issues, so the agreement and circumstances should be reviewed.

Can foreign workers bring a termination dispute in Bali?

A foreign worker’s rights depend on the employment relationship, agreement, and applicable Indonesian rules. Work authorisation and immigration status may also affect the situation, so individual legal advice is important.

How much does a termination lawyer cost?

Legal fees vary by lawyer and by the work required, so ask for a written fee agreement covering negotiation, mediation, court work, and any additional expenses. Under Law No. 2 of 2004, parties are exempt from court costs for claims valued below Rp150 million; this does not determine a lawyer’s fees.

What evidence should I keep?

Keep your employment agreement, termination notice, payslips, attendance records, and messages about the dismissal. Company rules, performance reviews, and records of negotiations may also help establish what happened.

Is mediation the same as a court decision?

No. A manpower mediator helps the parties seek a settlement and may issue a written recommendation if they do not agree. An unresolved case may proceed to the Industrial Relations Court, which can issue a decision.

Official resources in Bali

  • Bali Provincial Office of Manpower and Energy and Mineral Resources (Dinas Ketenagakerjaan dan ESDM Provinsi Bali): provides provincial employment services and information about labour dispute processes.
  • Regency or city manpower offices in Bali: local offices can receive records of failed direct negotiations and facilitate access to industrial relations mediation.
  • Denpasar District Court’s Industrial Relations Court: hears eligible employment disputes that remain unresolved after the required preliminary process.

Steps to find and hire a lawyer

  1. Preserve the deadline-sensitive evidence. Keep the termination notice and note when you received it. If you reject the notice, prepare a written objection within seven working days.
  2. Organise your documents. Within the next few days, gather your agreement, payslips, work records, relevant messages, and any proposed settlement.
  3. Identify the main issues. Write down the employer’s stated reason, the dates involved, and the payments you believe remain outstanding.
  4. Shortlist lawyers who handle Indonesian employment disputes. Ask about their experience with termination matters, mediation, and Industrial Relations Court cases in Bali.
  5. Compare advice and fees. Ask for an initial assessment, a written fee agreement, and an explanation of likely stages, costs, and possible outcomes before hiring.
  6. Agree on the next action with your lawyer. This may include responding to the employer, attempting bipartite negotiation, or registering the unresolved dispute with the relevant manpower office.
