Personal Injury Claims

We have considerable experience in the pursuit and defence of personal injury claims. You'll receive an early assessment and advice in respect of your prospects and the value of your claim, and we shall be happy to provide a free initial explanation of your potential entitlements and your options. We offer vigorous and efficient pursuit of your claim or defence, with access to expert advice and assistance from medical, engineering and other professionals. Our focus is on early favourable outcomes, with minimal delay between commencement and resolution of all claims. We have substantial experience across all fields of personal injury claims including workplace injuries, motor vehicle injuries, medical negligence and public liability claims, against private organisations and public authorities.

If you've been injured, be wary of "no win, no fee" arrangements that charge extra for a so called "win". At Archer Bushby you'll only pay for the work that's done for you, and as a successful claimant you'll be able to recover all or most of your costs from the other party.

Workers Compensation

If you’ve been injured at work, the prospect of dealing with our workers compensation system can be quite daunting. You might just want to know what your rights are and what lies ahead for you when you’ve been injured, what obligations you have and what you are entitled to expect from your employer and its insurer. We are happy to sit down with you to explain all of these things in clear and simple terms, and will do so free of charge.

If your employer has disputed your treatment expenses, or threatened to cut off or reduce your payments of compensation, we can help.

Do you have a right to lump sum compensation? What is the difference between this and a payment that is offered to you in “full settlement” or for a “full release”? You may have rights and entitlements you’re not aware of, and we can tell you about these and help you to obtain them. Accepting a lump sum offered to you by an insurer, or signing a document in return for such a payment can have far more serious consequences than you might imagine. What rights do you lose, what are the tax consequences, what amounts have to be paid out of what you receive? Will you still be able to rely on social security benefits if you need to?

In many cases you may just need some simple advice which we can provide free of charge. If you need representation, if you become involved in workers compensation tribunal proceedings, or if you simply want to put an end to the workers compensation nightmare and settle your claim, we can help.

Trusts

Trusts are frequently an important aspect of both tax and estate planning.

We provide comprehensive advice and service relating to discretionary and unit trusts, testamentary trusts and trusts for financial purposes, including both the creation of new trusts and revision of existing arrangements.

Wills and Powers of Attorney

Have you planned for what happens to your assets after your death? Passing away without a will means that your assets will be distributed in accordance with State intestacy legislation. This may not be what you want, and may not be in the best interests of your family. By making a will, you can be sure that your family is provided for and that your assets are distributed in accordance with your wishes

Have you considered what may happen to you and your assets if you become unable to deal with your financial and medical affairs? By appointing someone to act as your attorney and guardian, you can be sure that someone you trust will deal with your affairs in your best interests.

Preparing your will and making provision for the distribution of your property after your death can often involve difficult decisions and sensitive and private matters. We offer you confidential and experienced advice, and the preparation of a will that complies with all of the many technical requirements of the law so as to ensure that your affairs and estate can be dealt with simply and efficiently by those you leave behind. We will also keep your will in safe custody free of charge, if you wish.

If you’ve made your will with the Public Trustee or a trustee company such as Tasmanian Perpetual Trustees Ltd, you may not be aware that they charge very substantial commissions for the administration of your estate (in addition to their professional fees). As a result, the value of what is left for family members and others under your will can be significantly depleted. At Archer Bushby we charge no commission, and your estate will only pay for the work we do.
