Employment & Labor

Labor law belongs to social law which governs all relations between employer and employee. The labor code protects the rights of the employee.
It covers: training, execution and termination of the employment contract, freedom of association, collective agreements, conflicts, and compensation.

Only the labor court has jurisdiction to resolve disputes and conflicts related to the world of work.
It is strongly recommended that you hire an experienced employment law lawyer to defend your case before the competent authorities.

Steps and obligations of the employer towards the employee:

Complete the forms / Tofes 101 and 644: General information concerning the employee.
It must be completed each year by the employee before the end of February even if the information remains unchanged.

Establish an employment contract: document stipulating the terms and conditions of work.
It is given within 30 days of hiring.
It is up to the employer to check whether the employee already has another job.

Minimum Wage: An employer has the obligation to pay the amount of the minimum wage on the basis of a full week including 42 hours of work, or 182 hours/month. Each overtime hour must be paid.

Submission of pay slip and payment of salary: Before the 9th of the following month.
Late payment constitutes a violation of the employee's rights and, in the event of prosecution, it is possible to claim compensation.

Retirement: The contribution begins from the 3rd month of activity in the retirement fund.
The direct debit must be transferred before the 15th of each month.

Transport: Payment of transport by the employer is compulsory.
The amount of transport costs generally corresponds to the public transport rate.
Employers can cover the reimbursement of vehicle costs.

Paid leave: Dmei Avraha it varies depending on the employee's seniority and the nature of the position.
An employee contributes 1 day of paid leave per month worked. The employer may grant additional days off when negotiating the employment contract.
