AZR Advocaten is a partnership of mr. A. Orhan and mr. L. Leenders on the basis of a cost partnership. The lawyers act under a common name, but each work at their own expense and risk.

The assignments are accepted by the individual lawyer and not by the firm. The cost partnership is not a company as described in Book 2, Title 5 of the Dutch Civil Code.

The lawyers are not collectively but each individually insured for professional liability. Any liability is limited to the amount paid out in the relevant case under the professional liability insurance of the relevant lawyer.

With regard to planned absences, AZR Advocaten will ensure that clients are informed about this in writing or by telephone. Clients will be notified as soon as possible of the period in which one of the lawyers is absent. In the event of the absence of one of the lawyers, the lawyers within the partnership ensure that each other is replaced or replaced.

In the event that mr. Orhan is absent due to illness, vacation or otherwise, lawyer mr. L. Leenders will, in principle, deputize for mr. A. Orhan. Conversely, in the absence of mr. L. Leenders, mr. A. Orhan will, in principle, take care of replacement and replacement.

Third-party funds AZR Advocaten

AZR Advocaten is not affiliated with a third-party funds foundation and does not have a third-party account. AZR Advocaten is therefore unable to receive third-party funds. In the event of a court order for costs, these funds will be transferred directly between the parties, without the intervention of AZR Advocaten.

Immigration

Our office is particularly specialized in immigration law. We assist clients (both individuals and entrepreneurs) in various types of applications.

We can assist you in all phases of the procedure. Below are some examples of procedures.

MVV procedure

(If your partner is from another country, this can be the country of origin or the country of continuous residence). The foreign national must be 21 years or above, income must be equal to the minimum wage and the civic integration examination must have been passed. You must also make a plausible case of your family connection or relationship with the foreign national. The IND can deviate from all these conditions.

Chavez-Vilchez

An application under Chavez-Vilchez can be submitted if the parent (third-country national) intends to stay with a minor Dutch child. There must be a relationship of dependency.

Application without mvv

If you or your partner are already residing in the Netherlands and you cannot return to the country of origin to collect the mvv, but you do meet all the previous conditions, you can also submit an application in the Netherlands. However, you must prove that you have such special circumstances that you cannot be expected to return to the country of origin to collect the mvv. This is also known as a hardship clause. Based on your individual circumstances, it will be assessed whether the IND can reasonably object to the mvv requirement.

Exemption from the MVV requirement is granted in the following cases.

  • children born in the Netherlands;
  • children who are already in the Netherlands and have been going to school for three years (rooting of the children);
  • foreign nationals who request a change of purpose of residence and who have previously had a residence permit and who apply for a change or extension in good time. The application must be received by the IND within two years after the last residence permit has expired;
  • holders of an EC residence permit for long-term residents issued by another state of the European Union

EU review

Do you or your partner have the nationality of one of the EU countries? Then you may be eligible for a residence document or facilitating visa for EU testing under Directive 2004/38/EC. If you fall under this scheme, you will be subject to more relaxed regulations with regard to income and you will not have to take an integration exam. You must, however, make your family connection and relationship plausible. EU countries are Belgium, Bulgaria, Canada, Cyprus, Germany, Denmark, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Monaco, Norway, Austria, Poland, Portugal,

Romania, Slovenia, Slovakia, Spain, Czech Republic, Iceland, Vatican City, Sweden, Switzerland.

Long-term resident in another EU country

Apart from family reunification applications, you can also apply for a residence permit in the Netherlands if you have the status of long-term resident with an EU endorsement in another EU country, for example in Italy, Germany or Spain. You can qualify for this purpose of residence as economically active or economically non-active third-country nationals. You can be classified as economically inactive if a third party (family member) guarantees your income.
