If a company enters the market with the goods it produces or the service it provides, it is essential for the effectiveness of the market presence that the given product or service is markedly different, clearly distinguishable from other goods and services. The goal is for consumers to associate the given goods and services with the given business under all circumstances. Such distinguishing features can be the product's name, spelling, and related colors, shapes, and graphic elements. These distinguishing features make up the elements of the trademark, for which trademark protection can be registered. Trademark protection ensures that others cannot usurp our trademark, i.e. cannot use their goods or services with an appearance that is identical to, or can be confused with, trademarks registered by our customers. In addition to applying several other sanctions, the court prohibits the person who infringes the trademark from unauthorized use of the trademark, may even oblige him to destroy the goods affected by the trademark infringement, and obliges him to compensate the owner of the trademark for damages.

Trademark protection can be registered in three different procedures, depending on the geographical area for which the trademark holder wishes to obtain trademark protection. In the case of a national trademark, protection is provided for the territory of Hungary, in the case of a European Union trademark, the scope of trademark protection extends to the entire territory of the European Union, while in the case of international trademark registration, the trademark provides protection in the countries indicated by the right holder in the trademark application.
