Elder Law
When a person passes away, they usually leave behind some possessions (also called assets) and, for some, debts (also called liabilities) in one form or another.
Creating a will ensures that you have influence over how your assets are distributed when you are no longer here.
If you have not created a valid will before the time of your death, the law of succession regulates how your assets are distributed among your survivors.
The reasons for making a will can be many and depend on individual circumstances. These may include:
- A desire to make the inheritance the separate property of your heirs. This avoids the heir having to share the inherited assets with their spouse if the parties divorce.
- A wish for someone other than your immediate family to inherit from you, including charities, external family or friends.
- A desire to protect each other if you are unmarried cohabiting, as you will not inherit from each other unless a will has been drawn up in which you have determined this.
A desire to change the distribution of the inheritance among your heirs. This may be the case if you have limited contact with a child, the child has debts or other personal circumstances that make it more advantageous for other heirs to inherit the majority of your assets. However, this may also be the case if you as spouses want to protect each other as best as possible, including if you have children from previous relationships who will not consent to the surviving spouse being able to remain in the undivided estate.

It can seem overwhelming to change large parts of one's life and familiar framework from one day to the next, including the division of a house, contents, debt, cash, and children.
