FAQs

What is exchange of contracts?

Exchange of contracts takes place between the solicitors of the two parties (normally by telephone) and at this point the transaction becomes legally binding. At this point a completion date is set. The buyer will offer up a deposit at this point (usually 10%) which cannot be refunded if they pull out.

What is Stamp Duty and do I have to pay it?

You must pay Stamp Duty Land Tax (SDLT) if you buy a property or land that falls within certain price ranges in England.

If the property is in Wales the tax is different and you will pay Land Transaction Tax (LTT) .

The current SDLT threshold for residential properties in England is £125,000 and £150,000 for non-residential land and properties.

The amount of tax you will have to pay depends upon whether the property is for residential or non-residential/mixed use.

If you are buying a residential property there are different rates of SDLT if:

  • You are a First Time Buyer
  • You already own a property and are buying an additional property
  • You are not a UK resident’

What are searches and disbursements

Disbursements are expenses incurred during the conveyancing process paid by the lawyers to other third parties on your behalf, such as stamp duty, Land Registry fees,  and Searches. There are different types of searches that can be made on a property depending on its nature and location. We will advise you which ones are essential.

Searches are done to check the registers of various authorities in relation to the property including the local authority, water authority and environmental agency. They provide important information in relation to the history of the property which can enable you to make an informed decision before committing yourself to the purchase of the property.

Can I complete my house sale or purchase on any day?

No, unfortunately completion of your property sale and/or purchase has to take place on a working day, as the money used in the completion, or mortgage monies from a lender, will have to pass through the banking system. It is therefore not possible to complete on a weekend or bank holiday.
