The Elder Law Practice Group consists of experienced estate planning attorneys with specific skill sets to help navigate the complicated and far reaching issues our aging clients encounter. We create estate plans that take into account every facet of our client’s needs and desires. We identify problems and recommend solutions to keep our clients well cared for while maximizing their resources for themselves and their loved ones.

For nearly two centuries, our firm has been entrusted with the administration of countless private foundations, including the 21 foundations we manage today. The longevity of our practice has afforded us perspective, a deep expertise and understanding of the issues involved, and a superb track record in providing services to trusts and foundations.

In our estate administration practice, we work closely with family members to preserve harmony during what can be a sensitive, stressful time. Our in-house team has handled estates with a wide range of values, from insolvent to more than $40 million. We attend to every detail of the estate administration process, including probate, estate tax, post-mortem planning, sale of estate property, income tax advice, planning and preparation.

From pre-employment issues to separation issues, we advise our clients on how to avoid employment and labor related litigation, and we represent them in court when litigation cannot be avoided. Our attorneys appear on behalf of our clients before state and federal courts and agencies--including the Massachusetts Commission Against Discrimination and the Equal Employment Opportunity Commission--to present or defend claims for: failure to timely pay wages owed; wrongful termination; sexual harassment; employment discrimination; unfair labor practices; and other employment-related claims.

  • The Labor & Employment group represents 8 school districts in Massachusetts including charter schools and independent schools.
  • The group represents 10 restaurants and dining establishments in the greater Worcester and MetroWest area. (Note: Combined with other practice areas, the firm as a whole has served as counsel to more than 100 restaurants and restaurant groups).
  • On behalf of management for companies we represent, we have successfully negotiated 135 collective bargaining agreements with unions.

The family law team at Fletcher Tilton represents clients in probate and family courts, and in mediation, litigation, and pre-trial arguments concerning divorce-related matters. Additionally, the firm’s depth of resources in special needs planning, trust administration, estate planning and real estate allows the team to assist clients with all the legal needs that may arise from a divorce or other family law action.

We handle custody and guardianship cases involving children with special needs, and represent parties in same sex marriage cases, including the custody of children and the division of assets, with special consideration of the federal law’s impact on divorce. Further, our team can help with legal needs following a divorce, from trust and estate concerns to real estate matters. Our attorneys also assist clients on other issues, such as 209A protective orders and paternity actions.
