STATUTES OF LIMITATION IN GEORGIA CIVIL CASES

After someone has caused you harm, either financial or physical, you only have a certain amount of time to actually create a lawsuit in pursuit of damages. Each state has its own set of rules and regulations regarding this time limit, which is known as a statute of limitations. If the statute of limitations expires for your case type, you can still file a lawsuit but the defendant has the right to ask the court to throw it out, which will be done before any review.

In Georgia, statutes of limitations that may apply to your case are:

  • 2 years for financial loss due to fraud
  • 1 year for libel or slander
  • 4 years for damage to personal property
  • 2 years for medical malpractice (possible extension to 5 years)
