Bankruptcy & Debt

Bankruptcy is not a frequently used method of voluntary business liquidation or receivables pursuit in Turkey. The reason for this can be analyzed as the lack of a suitable environment for creditors, the priorities given to public receivables, and the high risks of legal and criminal sanctions for those who declare bankruptcy.

Our office provides services in bankruptcy matters, although it is rarely implemented in Turkey, as well as "bankruptcy postponement", which is a newer system that is more common in practice and includes restructuring and composition transactions together.

Our lawyers provide services to companies regarding the restructuring of their debts, financing and business models, as well as representation and consultancy services on the use of legal remedies by creditors against undue bankruptcy postponement procedures.

Employment & Labor

The principle of protection of workers, which is the basis in the field of Labor Law, has necessitated the need for regulations on this subject to be made in a separate law. In our country, there is a special law called the Labor Law. In this law; Issues such as definitions of employment relations, workers' rights, working conditions, and unions are regulated. It should be noted that the worker rights regulated are minimum conditions. The employer can rule more, but not less. In addition, although labor law is a branch of law that emerged with the idea of protecting the worker, this law also tried to prevent the emergence of unfair situations to the detriment of the employer.

Intellectual Property

Perhaps the most important point about Intellectual Property Law is that the legal protection of rights in this field depends on the principle of territoriality. Rights that are the subject of intellectual property are protected in accordance with the legislation of the country where protection is requested, or are not protected if there is no regulation in this regard. This depends entirely on the rules set by that country. An intellectual property right recognized in Turkey may not be recognized in another country and therefore may not be protected. Or the conditions regarding the protection of this right may change. However, at this point it is necessary to mention the role of international agreements. With some international agreements, intellectual property rights are subject to common rules by the party states. This means minimizing the different situations caused by territorial protection. With the existence of agreements to which our country is a party, it is possible for foreigners who are members of the states party to these agreements to receive protection in our country, and for citizens of our country to receive this protection in foreign countries. Another situation regarding international agreements in Intellectual Property Law is that international agreements are more prominent in this field of law. Accordingly, if the domain of the right is defined more broadly in the international agreement than the local law legislation, local protection will be provided within the scope of the international agreement provision.

Real Estate

One of the most important features of real estate is that their financial value is higher compared to other items. For this reason, the protection of these items or the legal actions to be taken regarding these items must be based on solid foundations. The legislator has made the establishment of rights on these items more difficult and complicated compared to movable ones, so that when making dispositions regarding the real estate of the person, the decision is made carefully and not in a sudden and unfounded way. Because immovable properties are items with high financial value, any damage that may be incurred will be higher than the damage in other matters, or damages that cannot be compensated financially may occur. In addition, since the construction of a new real estate, like building a building, is a matter that is costly and requires taking into account various situations such as environmental factors, it is legally obliged to meet certain conditions. The rules set in this direction must be learned carefully, down to the smallest detail. This is where a Real Estate Law expert lawyer comes into play. His profession is to provide guidance in terms of ensuring strict and detailed conditions regarding the preservation, transfer, or reconstruction of the real estate.

Business

The fact that commercial activities are of great importance for the perpetrators of individuals or institutions may cause the damages suffered in this regard to be large and irreversible. For this reason, legal consultancy in trade should perhaps be of higher priority than other areas. Thanks to this consultancy, accessing the knowledge of the legal rules regarding trade and acting within these rules can prevent the interruption of commercial activity or any damage, or eliminate the losses suffered to the maximum extent in terms of commercial activity. In short, legal consultancy on this subject helps to carry out commercial activities under the most suitable conditions.

Criminal Defense

We call Criminal Law the branch of law that forms the basis of acts considered crimes within the legal system and the penalties to be applied to them. While Criminal Law in a narrow sense deals only with crimes and the sanctions to be applied to them, Criminal Law in a broad sense includes criminal procedure and execution as well as these elements.

Criminal Law emerged in ancient times when people needed each other and formed communities. During these periods, while there was a practice of punishing behavior that harmed the community with sanctions imposed arbitrarily by the leader, with the emergence of states, the state that took over the authority had the authority to punish. As a result of the emergence of the idea of determining crimes and punishments with the codification movements in Roman Law, codification movements occurred with the influence of philosophical thoughts on this subject and the latest ideas about Criminal Law began to take shape. Accordingly, as a historical development in this field, there has been a tendency towards objective, general and abstract rules from practices that vary depending on the individual and the current situation.

Family

Undoubtedly, the dynamics that determine the structure of a society and its mass way of thinking or acting occur (or are introduced) in the families that make up the society and spread throughout the whole. For this reason, it is the smallest unit that constitutes society, which we can define as a multi-component organism. Considering that the rules of law regulate social life, it is natural that the importance that law attaches to the rules regarding the smallest unit of society is high. The rules set at this point were created to prevent harm not only to society but also to the individuals who make up the family. While the benefits of a healthy family life for the individuals who make up the family and society are obvious, it is also important for the individuals who make up the family and society to avoid any harm if the family unity cannot be maintained. For this reason, in case of a dispute regarding Divorce and Family Law, it is necessary to seek the advice of a family and divorce lawyer who is an expert in this field in order to resolve this dispute in the most fair and healthy way for all parties.

Media, Technology and Telecoms

As technology has reached the point, the internet has now become an alternative reality in itself. As a result, there was a need for this reality to be subject to some rules, and the field we call IT law emerged.

The legal rules established in the world in which people physically exist had to be adapted to the virtual world. Because the underlying element of this virtual reality is human. The fact that we can do some of what we can do physically in the virtual world has brought about the necessity of filling the gap here. In this sense, the aim of ensuring justice, which is the most important and sole purpose of law, also in terms of activities carried out in the virtual world, has been tried to be built under the umbrella of IT law.

The number of activities that can be carried out in the virtual world is increasing day by day. So much so that it can be said that the human mind is not yet aware of the diversity potential of these activities. For this reason, with every new situation that arises, the law must adapt to this situation. The process of diversification of the activities we mentioned is getting shorter and shorter. However, if we consider that the adaptation of law depends on this, we can see that IT law is a field that is more dynamic than other fields and includes the results of new situations that arise in a short time.
