Restart after bankruptcy? 10 tips for success. Which factors make a restart possible after bankruptcy? What are the chances of a restart? A restart after bankruptcy is often a good option, but when? mr. James Leliveld, corporate law and restructuring lawyer explains where the opportunities lie.
I used to be a curator. But honestly, I found it boring and frustrating. For the sake of form, the trustees always talk about (an investigation into) a restart, but it actually rarely happens. Why? Simple, the primary task of a trustee is the settlement of an estate and not a restart after bankruptcy.
In Jip and Janneke language, this means that the trustee must cash in as much and as quickly as possible on the assets of a company. This usually takes the form of a public sale. With the money that is released, he pays as many creditors as possible; but of course only after he has paid his own costs first.

On the other hand, I do understand. A restart after bankruptcy is often more complicated than a normal completion of the bankruptcy. It also often takes longer than a public sale. But the curator is also allergic to entrepreneurial risks. As a result, the trustee usually opts for the path of least resistance. And that is often the public sale.
Too bad of course. Because a restart often offers numerous advantages. In the end, this often yields more for the estate and a restart is usually better for employment.
That is also the reason why I stopped being a curator. It definitely gives a bigger kick to, for example, save a company in difficulties from bankruptcy or to realize a successful restart. That is better than a (boring) settlement of an estate. More intensive, but much more exciting and a greater intellectual challenge.
What you actually do is the following: you break up the company in the form of bankruptcy and then you “reorganize the company”. This redesign is of course accompanied by all kinds of measures to optimize the restart. You leave out the weak elements (such as unnecessary costs) from the past and take the most powerful parts with you. For example, an unbearable debt burden from the past can be resolved by bankruptcy.
But yes, is a restart always feasible? No, unfortunately not. That is, of course, the harsh reality. Bankruptcy is of course not for nothing. There must be a cause for that. Therefore, the 10 most important tips if you would consider a restart of a company:
