DIVORCE in Ireland explained:

A divorce allows both parties to terminate their marital relationship and remarry having been granted a decree of divorce.

The Grounds for a Divorce in Ireland are as follows:-

The Family Law Act 2019 implements the result of the 2019 referendum. It amends the Family Law (Divorce) Act 1996 and provides that spouses must now live apart for two years out of the previous three years before bringing divorce proceedings. These changes came into effect on 1 December 2019.

There must be no reasonable prospect of reconciliation between the parties.

The courts are in a position to make Property Adjustment Orders, Pension Adjustment Orders and Maintenance Orders, access and custody orders and domestic violence orders namely safety and barring orders and any further orders subject to the Jurisdiction of the court.

An application for a Decree of Divorce may be made in either the Family Circuit Court or the High Court and Maura Hurley Solicitors are here to help you with the application and to give you advice in respect of the procedure. and can deal with such applications nationwide.

DOMESTIC VIOLENCE 

 

The Domestic Violence Act 1996 provides for the protection and safety of married couples, co-habiting couples, children and any other people who live in a domestic relationship.      

Protection Available:     

 Under The Domestic Violence Act 1996, the following Orders may be obtained:   

  • Safety Orders
    • A safety order is an order or the court which prohibits the abusive person from committing further violence or threats of violence against the spouse, civil partner or a person who is not the spouse or civil partner, a parent or a dependent person. The respondent does not have to leave the house. An application for a safety order can be made to the family law courts and can be made for up to five years.
  • Interim Protection Orders
    • Where on the application of a person for a safety order  a court may make an interim protection order where the court believes that there is reasonable grounds for believing that there is an immediate risk to the welfare of a person or a dependent child. This order normally remains in place until the hearing of the safety application.
  • Barring Orders
    • The court can on application to it by a person make a barring order where the court is of the opinion that there are reasonable grounds for believing that there is a  risk to a person or dependent child and the barring order requires that the abusive party must leave the family home immediately  and prohibits the abusive party from entering the family home. A barring order can be made for up to three years.
  • Interim Barring Orders
     

 

  • The court may on the application for a barring order can if it is of the opinion that there is an immediate risk to the welfare of the applicant  between the application for a barring order  and the actual hearing  of the barring order make an interim barring order directing the respondent to leave the family home and to prohibit them from re entering the house for a period of 8 days.

If any of these Orders are breached by either party, the Gardai have immediate powers of arrest.

RESTRAINING ORDERS  CIVIL

A civil restraining order, also known as a ‘Section 28 Order’, directs a person to stop engaging in certain unwanted behaviours against another person, such as stalking or harassment.

Stalking and harassment are patterns of unwanted behaviour that affect your daily life. They can cause you distress or make you fear that violence will be used against you. Examples include following or impersonating someone, making harmful threats, or repeated unwanted contact.

If you or someone connected to you is experiencing stalking or harassment, you can apply for a civil restraining order.
