To divorce or separate quickly and at low cost, it is necessary to find an agreement. With the traditional procedure, even a single lawyer files an appeal with the Court and after about 3/6 months (the timing varies according to the Court concerned) the hearing will be held. Finally, the spouses who confirm the conditions of separation or divorce before the Judge will obtain the approval of separation or divorce sentence in the following months.

 Since  2014  the law n. 162 on the so-called  "assisted negotiation" , allows spouses who separate by mutual consent or divorce jointly, to find an agreement through the assistance of their lawyers. Within 10 days of reaching the agreement, the lawyers must file it with the competent public prosecutor's office. If the magistrate does not recognize any irregularity or incongruity, he grants the authorization or clearance in about 15/20 days on average.

With the entry into force of Legislative Decree no. 149/2022 (Cartabia Reform) it is now possible to obtain immediate divorce within a single proceeding through a cumulative application. This is an important novelty that will lead to a substantial reduction in times.
