Family

Family is typically the closest and most intimate relationship we have. But the love we have for our partner, children, parents, and siblings is unfortunately not always a guarantee that everything will run smoothly.

Just as two business partners can disagree about the operation of a company or the direction it should take, major – and sometimes insurmountable – disagreements can also arise within families. We see this most often in connection with divorce and inheritance cases.

Things come to a head, and the parties involved end up standing their ground. If ordinary mediation and common sense cannot solve the problems, the law must be brought into play – as the rational counterpart to the hurt feelings and shattered expectations. If the fronts have already been drawn so sharply that it has become difficult or impossible for the parties to talk sensibly together, an experienced lawyer can help with the necessary advice and – perhaps – get the dialogue back on track, or assist you if it is one of those cases that ends up in court. Attorney Charlotte Pedersen is trained as a mediator and thus possesses both a practical and theoretical basis for handling conflict resolution.

We always recommend that conflicts of the above nature are resolved amicably – and ideally that they are prevented with timely care in the form of, for example, a marriage contract and/or a will. Because even though it is not exactly the most exciting topic to bring up in connection with, for example, a wedding, it is a decision that is best made in good time, while relations are good.

We have the experience to create an overview and take into account the many eventualities that must be considered in connection with the preparation of, among other things, prenuptial agreements, wills, property division agreements, etc.

The purpose of our advice is to provide you with clear guidelines and a written, registered set of rules that can prevent or resolve disputes and doubts in connection with, for example, the division of property after a marriage or the death of a family member.

Generational change

If you are facing the upcoming planning and implementation of a generational change in your company, a prerequisite for a successful generational change is that thorough considerations are made regarding family and inheritance law matters.

We have extensive experience in advising on generational change and in determining whether it is necessary to create a prenuptial agreement and will for a successful generational change.

Employment & Labor

Labor and employment law is an area that is only becoming more and more complex. We have Danish and Greenlandic workers, Faroese trawler skippers and people from Canada, Scotland, China and almost everywhere else in the world.

We also have Greenlandic legislation, Danish collective agreements and a host of more or less home-made employment contracts. Which set of rules applies in which situations is not so straightforward to answer.

At Nuna Advokater, we have been dealing with employment law in Greenland for many years, and we therefore have many years of experience in all aspects of employment and labor law.

We also have the competence to assist in drafting employment contracts, so that a concrete written basis for employment is established, thereby reducing the risk of conflicts or making conflicts easier to resolve.

We assist both on the employer side, where we have represented a number of Greenland's largest companies, municipalities and public authorities, and on the employee side, where we have assisted a number of employee organizations.

When we are involved in an employment law matter, we always start by exploring the possibilities of resolving the conflict through negotiation. Attorney Charlotte Pedersen is trained as a mediator and thus possesses both a practical and theoretical basis for handling conflict resolution.

If a conflict cannot be resolved through negotiation, we also have the competence to take the case all the way to a legal decision. Over the years, we have conducted a large number of legal proceedings in the courts and have built up extensive experience with litigation in employment law disputes.

In addition to mediation and conflict resolution through the legal system, we also assist our clients with advice in connection with, for example, severance agreements, dismissals, expulsions, changes in terms or employment contracts with the overall starting point of providing the best possible advice and ensuring that our clients' needs are met in the best possible way.

We focus on close collaboration and prioritize an open process in our approach.

Real Estate

Carrying out a major contract or construction project in Greenland is in itself a bit of an achievement. The climatic conditions alone impose some requirements that are not seen in many other places. Add to that factors such as Greenlandic legislation, the supply of labor, access to building materials, etc.

As Greenland's leading law firm, we are also the leaders in real estate and construction consultancy. Our expertise in this area encompasses the entire construction process, from initial investigations and identifying opportunities to screening potential partners, drafting contracts, tendering law and composing consortia – including public/private partnerships (PPP).

We have gained many years of experience as advisors in a wide range of large and small and sometimes very complex construction projects, and have represented a number of the largest contractors and developers in this regard. In addition, we have conducted a large number of arbitration and litigation cases regarding construction and real estate over the years.

We know the real estate sector and have a broad and strong network among Danish, Greenlandic and international developers – public as well as private – contractors, project developers, as well as the various public authorities that have interests in the sector.

We work in the tension between clauses and concrete, and although you can never be 100% sure that disputes will not arise in major construction projects, in the vast majority of cases we are successful in resolving minor problems before they become large and costly.

So whether it is about acquiring real estate or a major construction project, we have the expertise in the field. We advise our clients in connection with specialist, large and main contracts, turnkey contracts and consultancy contracts. We help with planning and organizing construction cases, identify and cover risks and participate continuously in the development of major construction cases.

In addition, we also work with the transfer and acquisition of real estate, applications for land allocation, etc. The special conditions that apply to real estate in Greenland are part of our DNA.

Bankruptcy & Debt

Nuna Advokater's competence in this area is unparalleled in Greenland, as lawyer Peter Schriver is probably one of the Kingdom's most experienced lawyers in this area.

Peter Schriver has handled a number of the largest suspensions of payments and bankruptcy estates both in Denmark (including KKS Entreprise, Svendborg Værft, Nordsø værftet and Århus Flydedok) and in Greenland (including S&G (Entreprises etc., Tasiilaq), Brdr. Lyberth (Shipping etc., Maniitsoq) and Qaqortoq Værft. To name just a few among many.

Bankruptcy is rarely beneficial to anyone, and it is always unfortunate when a company is on the verge of bankruptcy. For the owners, for the creditors and not least for the employees and thus for society as a whole.

When we deal with a bankrupt estate or a bankrupt company, we always seek to advise both creditors and company owners with a view to securing the company's values as best as possible - for the benefit of all the company's stakeholders. And in this connection, we will always start by exploring the possibilities for a reconstruction of the company with a view to ensuring that all or part of the activities can continue, which, all other things being equal, will secure the values as best as possible and at the same time secure the company's jobs.

Over the years, we have carried out a large number of reconstructions both by using the composition institute - both voluntary and forced composition - and by transferring to continue under new management.

In addition to handling insolvent companies and bankruptcy estates, we also have extensive experience with debt collection.

We provide direct, individual advice as well as more standardized forms of debt collection cases, where we, in collaboration with the district courts and the Court of Greenland, have a fixed procedure for how a debt collection case should be conducted most appropriately, given the special challenges we have in Greenland.

Lawsuits & Disputes

A lawsuit is always the last option to resolve a conflict. Lawsuits are typically unwanted, lengthy, and often both resource- and cost-intensive. Furthermore, the outcome of a lawsuit is often never a given, no matter how good a case you think you have.

That is why we always try to resolve cases through voluntary settlements before they end up in court. This is usually in everyone's best interest. Attorney Charlotte Pedersen is trained as a mediator and thus has both a practical and theoretical basis for conflict resolution.

When it is not possible to reach a settlement, we take the case to court - regardless of whether it is the district courts, the Court of Greenland, the High Court of Greenland or a Danish court, if the jurisdiction is such.

Initiating a lawsuit can also be a strategic consideration to force a reaction and open a dialogue – fortunately, a lawsuit does not always have to end with a decision in court. We work strategically and constantly consider our clients' possible pleadings, with the possibility of reaching a settlement that can satisfy both parties.

Our lawyers organize a trial process as appropriately as possible and always advise on the procedural risk involved in conducting a trial. Regardless of the extent of evidence, trials are almost always an expression that a matter can be discussed and fall out to both sides.

Therefore, it is important to be represented as best as possible in and during the choice to take the big step of filing a lawsuit. The process must never become a litigation risk in itself.

Business

As the leading law firm for the Greenlandic business community, corporate law is naturally one of our absolute core competencies. We provide advice within all phases of a company's development - from start to finish, including establishment and incorporation, expansion, transfer and dissolution. We provide advice on management consulting and capital changes.

We have a full overview of the possibilities, limitations and pitfalls. Our assistance includes everything from ownership agreements, the formation of groups, company structures and the associated advantages and disadvantages of choosing and rejecting different company forms.

The legislation on corporate matters in Greenland is not entirely identical to the Danish one, and one must be aware of the small differences – as is well known, the devil is in the details. Our work has over time given us a broad experience with company formations, restructurings, mergers, divisions, liquidations, divestitures, etc. – all parts of a company's life and phases.

It is also an important part of our corporate law assistance to advise newly founded companies, help entrepreneurs and start-ups get started, assist with finding venture capital, draw up business plans, partnership contracts, owner agreements, etc.

In addition, we hold a number of board and executive positions in a number of Greenlandic companies.

We create value for our clients and work proactively to present solutions before a company's challenges become insurmountable.
