Litigation and Arbitration

Since its founding in the 1950s, the Litigation, Arbitration & Dispute Resolution Team has always been one of Studio Pedersoli's greatest strengths. A rigorous working method, that has been handed down over the years to young lawyers, has made the firm a market leader for both the quality of the advice provided and accuracy of its professionals.

Because of their team of over forty professionals, the firm is able to competently and quickly assist clients, with their significant experience. They can handle the most complex and delicate pre-litigation and litigation before judges and arbitrators as well as in proceedings before supervisory authorities, regarding:

  • Corporate law, such as liability actions against corporate bodies, disputes between shareholders, violation of shareholder agreements and non-competition agreements, shareholder and board resolution appeals, class rights and disputes regarding withdrawals;
  • Extraordinary transactions, such as takeover bids, company transfers, mergers, de-mergers, joint ventures, share acquisitions and other financial instruments all involving litigation for compensation, appeals, oppositions, complaints, contractual breaches and violations of law and special regulations;
  • Civil law, including wills, estates and trusts and the rights of individuals;
  • Civil liability (including liability for unfair competition, damage to commercial reputation and damage to image);
  • Banking and financial law, including intermediary liability, derivatives (even if stipulated by public bodies), current accounts and credit lines, bank guarantees, leasing, mortgages, other financing and dealing with the Centrale Rischi (the Italian Bank Risks Bureau);
  • Competition law (including public enforcement and follow-on actions);
  • Business crisis and insolvency law;

  • Commercial contracts for major industrial sectors;
  • Public and private contracts;
  • Sanctions proceedings initiated by supervisory authorities (such as CONSOB and the Bank of Italy) and filing appeals.

The firm's interdisciplinary team provides a tailor-made approach to each dispute, while constantly monitoring and updating clients regarding the anticipated costs and benefits. The best defensive strategy is always proposed throughout the procedural process, aiming to provide solutions where disputes can be settled out of court both through articulated settlement agreements (including commercial ones) and through ADR procedures. This saves clients time and money, and eliminates the risk of litigation. Because of Pedersoli's strong international network of foreign firms, they can skillfully handle domestic as well as cross-border disputes.
