Can I join a class action in Austria for a faulty smartphone purchase affecting many customers?

I'm in Austria and I'm curious how class actions (collective redress) work here for consumer defects. If a retailer sold a phone with a defect to many customers, can we join one suit rather than file dozens of individual claims? What steps are involved to participate, and would I need to hire a lawyer to join?

Austria does not have traditional U.S.-style class actions. However, consumer protection organizations can bring representative claims on behalf of affected consumers. For widespread defects (like a faulty phone), you can usually join such actions by registering with the relevant organization. Each consumer still remains a party to their own claim, but coordinated procedures make it easier. In addition, third-party litigation funding (Prozessfinanzierung) is sometimes available, which can help cover legal costs for collective consumer claims. Depending on the court and claim value, hiring a lawyer may be mandatory, and legal advice is strongly recommended to protect your rights. Our firm can assist you in evaluating your options and, if needed, representing you in such collective consumer claims in Austria.
