do i still have a chance to reclaim to property

sometime last year around september 2024 i took my Mitsubishi Colt van to a pawn shop. i came back a month a 2 weeks late to reclaim my car from this Ntshwarelela Pawn shop and to surprise the owner refused with my car claiming i am late now he has sold the car. i pleaded with them to reclaim their P6000.00 which i owed them, they refused until i came to point where i gave up.

this year around April 2025 i met someone claiming to be a debt collector. he promised to help me reclaim my car and charged me around P4000.00. They guy forced me to Pay P1600.00 as deposit to help me at court. to my surprise the guy claimed to have registered my case at court but when the court date approached the guy told me he wont help me any further because i have not cleared the P4000.00 so his lawyers wont appear for me at court on that date he claimed to have been set for us. i asked him the consequences of missing the court date that was given, he said if i dnt pay they are going to miss court date. i asked him to give me a draft of a demand letter of my case (he verbally told me he submitted the letter to the pawn shop), he refused until he stopped communicating with me. my question is do i still have any chance to be helped with my case to reclaim my property/ car.

Hello
Thank you for reaching out and sharing your situation. It sounds like you have been through a very difficult and stressful experience. Please know that you may still have options to reclaim your property or seek justice.

Based on the details you provided, here is a general overview of your situation. Please note that this is not legal advice, and a thorough review of your case would be required to provide specific guidance.

Your situation with the pawn shop
The legality of the pawn shop selling your car depends on the specific laws in your jurisdiction and the contract you signed. Most places have regulations that dictate how long a pawnbroker must wait before they can sell a pawned item. In some cases, there are grace periods that extend beyond the original due date. It would be important to review your original pawn agreement to understand the terms and conditions.

Your situation with the debt collector
The person you dealt with who claimed to be a debt collector has shown several red flags that are common in debt collection scams. Legitimate debt collectors are required to provide written validation of a debt and should not pressure you for upfront payments without clear legal action being taken. The fact that this person refused to provide you with a copy of the demand letter and then ceased all communication is highly suspicious.

You may still have options
While this is a complex situation, you may still have legal recourse. This could potentially involve a civil claim against the pawn shop if they did not follow the proper legal procedures for selling your vehicle. Additionally, you can and should report the fraudulent debt collector to the authorities.

I understand you are looking for affordable assistance. I can offer you a low-cost consultation via WhatsApp to discuss your case in more detail and help you understand your options. Please feel free to contact me to arrange a time to chat.

Best regards.
