CONDITIONS FOR REGISTERING A BUSINESS IN THE DRC

1. Your situation: a lease agreement + a certificate from the landlord.
Yes, this situation is legally permitted in the DRC. You do not need to own the premises to register your business. In practice, at the One-Stop Shop for Business Creation (GUCE), only proof of a registered office in the DRC is required, which may be: a commercial or professional lease agreement; a certificate of registered office (from the landlord or a third party) or a title deed (optional). Therefore, your lease agreement is sufficient. A certificate from the landlord strengthens the application

2. Documents generally required (RCCM / GUCE)
A. For a sole trader (business)
Essential documents are: a copy of your ID; a registration form; a lease agreement or certificate of registered office; a criminal record check or sworn statement; a letter of application and proof of payment of fees.
B. For a company (LLC, SAS, etc.)
The main documents are: the signed articles of association (4 copies); the declaration of subscription and payment of capital; proof of capital deposit; identity documents of the partners/managing director; specimen signature; application letter; proof of registered office (lease or certificate) and proof of payment of fees.

3. Practical advice.
To avoid your application being rejected, please have the certificate signed by the landlord and attach a copy of their identity document; clearly state the full address; indicate authorisation for commercial use and check that the lease permits commercial activity.
