I’m planning to start selling handmade items on Instagram and a local marketplace, using my home address. I haven’t formed a company yet and I’m unsure if I must register as a sole proprietor and when the certificate is required.

Great question, and very common for those starting out in Hong Kong!

The short answer is yes - a Business Registration Certificate is required. Under the Business Registration Ordinance, selling goods or services in Hong Kong (including via Instagram or local marketplaces) constitutes carrying on a business, regardless of whether you operate from home or have formed a company. As a sole proprietor, you are required to register with the Inland Revenue Department within one month of commencing business.

The good news is that the process is straightforward, and registering as a sole proprietor is a simple and cost-effective way to get started.
