X visa

In India
Last Updated: Nov 24, 2025
Hello,

My husband is Indian citizen and I am Dutch. We got married in Abu Dhabi. Indian embassy refuses attesting our marriage certificate because we don’t live in UAE and don’t have an Emirates ID. If we divorce in UAE, can we marry again in India without risking bigamy charges?

If we get a baby, can I get an X visa then based on parental relationship if we stay married in UAE without legalization?

We want to build our life in India. Without an X visa it is so complicated.

Hello and greetings, I read your query regarding your marriage in Abu Dhabi and the difficulties you are facing with the Indian Embassy and X-Visa process. Based on the complex international laws involved (UAE, India, and Netherlands), I wanted to share some preliminary legal insights that might help you: Attestation vs. Apostille: You mentioned the Indian Embassy refused attestation. However, a crucial update is that the UAE joined the Hague Apostille Convention in early 2024. This means you may no longer strictly need "Embassy Attestation." A UAE Apostille (issued by the UAE Ministry of Foreign Affairs) is technically valid in India and can be obtained even if you are not currently a UAE resident. This could solve your X-Visa document requirement without needing an Emirates ID. Divorce & Remarriage: Please be very careful about marrying again in India while your UAE marriage is still legally valid. Under Indian law, this could risk bigamy charges, as your previous marriage exists even if it isn't "attested." However, if you were married under the Abu Dhabi Civil Family Court, their specific laws often allow non-residents to file for divorce remotely if the marriage took place there. If you divorce first, you can then marry freshly in India under the Special Marriage Act, which is the safest route for your long-term plans. X-Visa & Child: Obtaining an X-Visa based solely on a child is complicated if the child holds Dutch citizenship (via the mother) rather than Indian citizenship. The "Spouse" route is much stronger, but it requires the marriage certificate issue to be resolved first. These matters are sensitive and require a strategic approach to avoid future visa rejections or legal hurdles in India. I am a legal consultant and can guide you through the specific steps to either legalize your current certificate remotely or correctly restructure your marriage registration to ensure your family's smooth entry into India. Since I am currently based in Iran, I offer affordable, text-based legal consultation directly via WhatsApp. I can help you draft the necessary applications and guide you through the process step-by-step. Best regards,
