How do I file a civil claim for land boundary encroachment by a neighbor in Indonesia?

The neighbor has built a fence that crosses onto my property. I want a court order to stop the encroachment and to have the boundary properly determined. What documents are needed, how long does it take, and should I hire a local Indonesian lawyer to handle the case?

Before going to court, ask the local Land Agency (BPN) to request a land survey and establish boundaries. If the boundaries are already known but your neighbor insists on building a fence on your land, issue a warning first. If no agreement can be reached, file a lawsuit for unlawful acts with the district court where the dispute is located. My advice is to find a credible and experienced local attorney.

Dear Client,

Thank you for your question.

The first thing you can do is send a written warning to your neighbor. As a second step, you'll also need a written statement of the National Land Agency's measurement results, including the measurement letter, a picture of the situation, and a map of the land.

If there's still no progress, you can file a lawsuit with the District Court. Further, to facilitate communication and maintain pressure, it's best to hire a local attorney.

We hope this information is sufficient.

hi, Before we provide further advice, kindly confirm whether you are an Indonesian citizen (WNI) or a foreign national (WNA), as land ownership and land rights in Indonesia are subject to different legal regimes depending on citizenship status. In principle, a boundary dispute may be pursued through a civil claim to cease the unlawful encroachment and to request a judicial determination of the lawful boundary. The required documents generally include the land title certificate, survey map/measurement letter, proof of land tax (PBB) payments, as well as site documentation (photographs and chronology of events). Proceedings before the District Court typically take approximately 6–12 months, depending on the complexity of the case and evidentiary process, including the possibility of a site inspection. Given the technical nature of land matters and evidentiary requirements, we strongly recommend appointing a local Indonesian lawyer to ensure that your rights are effectively protected in accordance with applicable legal procedures. Kind regards,
