I resigned from a job effective January 15, 2026. However, I gave 2 weeks notice and made my last day at the employer January 30, 2026. My manager said the notice period isn't necessary as I'm still in the probationary period of the employment stage. Since the 2 weeks notice wasn't relevant in my case, I had stopped before January 30th, made my last day January 19, 2026. I should have receive my final salary January 25, 2026 and since that day falls on a weekend the salary would be payable on January 23, 2026. Nevertheless, I have not receive my salary and the company did payroll and paid everyone with the exclusion of me. So I texted my manager on the matter stating I'm going to speak to an attorney as it relates to me not getting paid and I'm going to summon if necessary.

Thank you for outlining the situation. Once you performed work up to January 19, 2026, you are legally entitled to be paid for all days worked, regardless of whether you were on probation or whether the full two-week notice period was required. Yes, probation affects notice requirements, but it does not remove your employer’s obligation to pay you for work already performed. If payroll was processed and you were excluded despite having worked during the pay period, that is a matter that should be addressed promptly. At this stage, the advisable steps would typically be: Send a formal written request (email or post) requesting payment of all outstanding wages by a specified date. Keep records of: Your resignation communication, Confirmation of your last working day, Payslips or prior payroll history, Any messages regarding payment. If payment is not made, you may: File a complaint with the Ministry of Labour and Social Security, or pursue recovery of wages through the Parish Court. It is generally best to follow up with a formal demand before commencing proceedings. If you would like assistance drafting a demand letter or assessing the best recovery route based on the amount owed, I would be happy to discuss scheduling a consultation.
