How do I start arbitration in Mexico for a commercial contract, and what timelines and costs should I expect?

I have a breach dispute with a supplier and the contract includes an arbitration clause under Mexican law. Could you outline the steps to initiate arbitration in Mexico, the typical costs and duration, and how an arbitral award is enforced domestically and, if needed, abroad?

It is important to review the arbitration clause first in order to assess its enforceability. In some instances, judicial jurisdiction may still be available if the clause does not contain an express waiver of the parties’ right to submit to the courts having jurisdiction by reason of domicile or nationality.

We would be pleased to assist with this preliminary review and provide our comments thereafter.

All will depend on the contract structure, jurisdiction, and applicable law. Regards,
