Road collision

In New Zealand
Last Updated: Feb 23, 2026
A person pulled in front of me when I was on a pedal bike and hit the side of the car. I’m battered, cut and bruised, my ribs are bent in from the handle bars. Witness gave statement to the police. Not my fault and ACC have accepted the claim for the medical expenses. I have no broken bones fortunately. My bike is unusable. This is my mode transport. Can you help? Thanks [name removed]

Thank you for reaching out, and we’re very sorry to hear about your accident. We’re glad ACC has accepted your claim for medical treatment, but you may still have important rights and remedies available in New Zealand. Under NZ law, ACC generally covers treatment and rehabilitation costs for personal injuries, which means personal injury lawsuits for damages are usually limited. However, that does not mean you have no further recourse—particularly regarding your financial losses and property damage. Based on what you’ve described, you may be entitled to pursue: 1. Compensation for Your Bicycle and Gear: Damage to your bike and related equipment is typically recoverable from the at-fault driver (or their insurer), as this falls outside ACC coverage. 2. Out-of-Pocket and Economic Losses: Depending on your circumstances, there may be additional recoverable losses not fully covered by ACC (for example, certain wage issues or related costs). 3. Support With ACC Entitlements: Even though ACC has accepted the claim, we can review whether you are receiving your full entitlements (weekly compensation, treatment support, rehabilitation assistance, etc.). 4. Liability Position: The witness statement and police report will be important in establishing fault and strengthening your recovery claim against the driver’s insurer. Recommended Next Steps: To assess your position and move forward efficiently, please provide: - Copy of the police event number or report (if available) - Witness details (if you have them) - Photos of the damaged bicycle and gear - Estimated replacement or repair cost of the bike - Any correspondence from ACC - Brief description of your injuries and current work status Once reviewed, we can advise on the strength of your recovery claim, assist with insurer negotiations, and ensure your ACC entitlements are fully optimized. We look forward to helping you get properly supported and back on the road as soon as possible. Sincerely Ascendance International Consulting
