Can I sue a suppliers' cartel in Pakistan that fixed prices and blocked my company from tenders?

I run a small manufacturing business and several suppliers seem to coordinate identical price increases and refuse to deal with me unless I accept their terms. Because of this, I lost multiple tender bids over the last 6 months. What evidence do I need and can I claim damages through an antitrust case?

If suppliers are coordinating prices or collectively refusing to deal with you, this may amount to cartelization under Pakistani competition law. However, these cases depend heavily on solid documentary evidence. I would need to review your quotations, correspondence with suppliers, and details of the tenders you lost before advising on the strength of a complaint or damages claim. If you would like to proceed, we can schedule a consultation to assess the matter properly. Saeed & Moeez Law Firm

Respected Sir, In response to your email please note that under the Competition Act, you must prove coordinated agreement, not just parallel pricing. Required evidence, emails/messages about pricing, meeting records, collective refusal to deal or documentation showing suppliers agreed to price terms. Identical price increases alone are insufficient. The investigation and enforcement authority is the Competition Commission of Pakistan which can impose penalties and remedial orders if coordination is proven. Best regards, Ch. Based on what you have described, the conduct may potentially amount to anti-competitive behaviour, such as price-fixing or a concerted refusal to deal, depending on the underlying facts and supporting evidence. In matters of this nature, direct proof of an agreement between suppliers is uncommon, so both direct and circumstantial evidence are important. You should begin preserving and compiling all relevant material, including written communications from suppliers, records showing identical or simultaneous price increases, and any correspondence where supply was made conditional upon accepting uniform terms. It is also helpful to gather tender documentation demonstrating how these coordinated price increases caused you to lose bids, along with market data showing that the increases were not independently justified by raw material costs or other legitimate commercial factors. Evidence suggesting coordination through trade associations or industry meetings may also be relevant. Parallel pricing alone is generally insufficient to establish a cartel; there must be some indication of an agreement or concerted action. Therefore, the strength of a potential claim will largely depend on whether the available evidence can reasonably demonstrate coordination rather than mere coincidence. If an unlawful anti-competitive agreement can be established, you may have grounds to claim compensatory damages for the loss of profits arising from the tenders you were unable to secure. You would need to demonstrate the existence of the anti-competitive conduct, that it breached the applicable competition law, that it directly caused your losses, and that those losses can be quantified with reasonable certainty. As an immediate step, you should preserve all documents and avoid any action that could compromise potential evidence. It would also be advisable to conduct a preliminary assessment of the financial impact of the lost tenders. Depending on the jurisdiction, you may either file a complaint with the relevant competition authority for investigation or initiate a civil claim for damages, or pursue both routes strategically. Please let me know the jurisdiction in which this conduct has occurred so that I may provide more specific guidance on procedure and available remedies. Kind regards, Rana Muhammad Ahmad
